hi,

legal advice naman po on what to do, nag file na kasi ako ng resignation 30 days, it was accepted. then a few days later bigla ako binibigyan ng memo 20 days suspension due to tadiness. ang issue is sinerve nila memo on an appropriate time since yun mga late infractions ko was last year pa. 5 infractions starting may, june, august, september, october. dapat kasi binigay na nila memo agad nung umpisa pa lang since meron dito na written warning, verbal reprimand, 2, 3, 15 days suspension. ang ginawa is inipon nila. so ang mangyayari parang gusto ibawas sa backpay ko (sa remaining VL and SL ko) tama po ba kung ganun ang gagawin nila?

if i go that way ma clear pa ba ako? will they still clear me knowing na nireklamo ko sila sa dole?

Required ka magpa-clearance and required din sila mag process ng dapat mong matanggap.

moderator
retaliation under the labor code contemplates that the employee filed a case or testified against the company. the more proper charge would be illegal suspension and money claim.
