technically, it's called simulation of birth, not falsification. but yes, it's a crime.

we were once asked the same question when I was in legal aid at my law school. our supervising lawyer told us to recommend that they just leave it be because they would expose themselves to a criminal complaint.

nevertheless, there was an amnesty granted when the law on adoption came out, but that has already expired. there are pending bills in congress to provide amnesty again to allow couples who simulated birth to properly adopt their children. you should monitor this if you intend to adopt the child.

Thank you so much atty,

Our fear now, kung halimbawang bawiin ng nanay ung bata, na huwag naman sana mangyari, may reason ba kami na hindi pumayag na kunin ang bata?

thanks again po.

if she does, tread carefully. failure to return a child is kidnapping of minor. the most you can do is ask for payment for what you've spent on her but you cannot legally refuse to give the child back.
