Are Company Drivers covered in Article 82 of the Phil Labor Code: Normal Work Hours or are they considered field personnel?

they drive for a well known photo studio. they are using a utility van. they normally pickup/deliver items to and from branches.

Hi,

Is this legal?

driver comes in at 8am then finishes at 630PM on a regular workday...then asked to do overtime from 7PM of the same day to 6AM the next day then asked again to come in at 8AM for his next day shift. Three shifts in a row. If this is allowable in the Labor Code, what pay should the driver receive for the 7PM-6AM overtime? Should it just be regular OT rate? at this point the driver is on his 2nd month employment with the company.

The "2nd month" is irrelevant to the overtime concern.

530 PM - 10 PM = regular OT
10 PM to 6 AM = night diff

The employer should be considerate after having the driver do a double shift.
