Hello everyone!
Thi is my first post.

I need a LEGAL advise.

I was not able to go to work for almost two weeks now due to severe headache and depression cause by workplace bullying.

This was started when had a new supervisor in our process (I was working in a Manufacturing Company).

I have been there as regular employee for almost a year. (Bali nauna ako sa bagong SUPERvisor)

Since this SUPERvisor become a regular employee, my co-workers change their attitude towards me. Our friendship vanish in an instant. I don't know why. I always approach them, but they always ignore me! I've reported the situation already to our new SUPERvisor. He told me that I am the reason why my colleague always disregard that really affected my work (No Endorsement!)

Now, I am so depressed with this case causing me not to go on duty. Within the first week of my absent I always notified my SUPERvisor but the following days I occational notify him coz I am confused.
I really passionate my work but working in a workplace like that is really annoying!

Ayaw naman magsalita ng mga tropa ko biglang nagbago at halatang may kinakatakutan.


WHAT SHOULD I DO ??

Please help me. . . .

Go to a doctor and get a medical certificate and get yourself checked.

Then report to work.

BTW, what do mean by "get yourself checked" ???

Is there a posibility that my New SUPERvisor will dismissed me?
.....ang hirap pinag-iinitan talaga ako, walang kakampi!


May magagawa kaya ang HR dito?

Yes.

Sir, paano po kung ganito?

Bali nagpasa na ako ng medical certificate at fit to work na ko ng Doctor ng clinic.

Kaso during the same day nag-file na ako ng resignation without further notice (effective kinabukasan agad) which is allow naman ng SUPERvisor ko at HR (bali kaharap ko sila during the forum namin)

Bali hand-written nga lang yung resignation ko na suggest ng HR. (Dahil na rin siguro sa conflict between me and my SUPERvisor.)

Sa tingin niyo po ay maka-exit ako ng ayos na walang problema?

After nun (same day) nagpa-clearance na ako. May mga pirma pa na hindi na natapos (reason kasi urgent ang resignation ko n allow nila) suggest ng HR eh siya nalang daw ang magpapirma nung natira. Bali surrrender ko na yung ID ko sa SECURITY which is yung last na pinapirmahan ko dun sa clearance ko.

Tama po ba ang Due Process nun? I mean hindi ba ako napaikot ng HR?

BTW, legal po ba ang walang separation pay ng isang Regular Employee yun ang sabi ng HR???

Tama lang yan. Pinayagan kang mag-resign so tapos na ang usapan at wala nang usapang tungkol sa pag AWOL o absent mo.

Walang separation pay ang kahit sinong employee basta nag resign.

Pwera na lang kung merong policy o benefit ang company na nagbibigay ng ganoong benefit sa lahat.

Matatanggap mo lang ay:

1. huling sweldo sa mga araw na hindi pa nababayaran
2. pro-rated 13th month pay
3. pro-rated leave conversion (service incentive leave, max of 5 days per year)
4. tax refund/adjustment

1. Pro-rated 13th month pay? ...bali ngayon March ako nag-resign.

Hi.

How about an employee who filed resignation this March and a regular employee in a Manufacturing Company for more than a year (1year and 1month) ?

Assuming his monthly salary was 10K php?

Assuming his monthly salary was 10K php?

Sorry, walang kinalaman ang pagiging regular employee for 1 yr & 1 mo.

If 10k ang sahod, then estimated 13th month is 2500.

Any tax refund depends on total salary, taxes withheld, and tax exemption.

Health card - none. Parang insurance yan, pag hindi nagamit, thank you na lang.

When to follow up?

Money claims - you have 3 years in which to file for them.

Releasing - no definite time frame. Ask them. Generally, it should be within reasonable time.
