Good day po.

I am working at a BPO company. I have been working for like 3 years here. I was promoted from being a Level 2 Tech support going to Network Engineer last Nov 19, 2013.

Sabi nung HR namen eh 4 months Probi po kme. But sabi dn nila hinde na dapat umabot pa sa 4 months dapat mga around 3 months plang eh magkaroon n  ng feedback ung supervisor namen for our performance.

Last Feb 19 pinapirma na ako ng supervisor ko for the performance review and the feedback is good so meaning tuloy na ako dito sa position ko as Network Engineer.

Ang tanong ko lang po eh since regular employee ako at napromote lang ung 4 months na pinagtrabahuhan ko as sort of probationary for the promotion entitled ba na ibgay ng company ung retro for whatever the increase I will be getting or not.

Or san ba mgsisimula un? kasi 3 months plng nareview na ung performance namen so ung at least 1 month ba dapat retro. parang ang nangyari po kasi eh nung mailabas na ung performance review ng boss ko about sa probi work ko eh hinintay tlga ng HR na dumating ung fourth Month ko sa my work bago nila ibgay ung confirmation na OK n ako at ung raise..

Another question po..kasi hnde namn po nadiscuss samen ng HR ung standard kung panu ba kme mgququalify sa position namen meaning ininform lang kme na kapag OK evaluation namen saka kame macoconfirm tpos after 3 months eh may form na lumabas for review ung ang pinagbasehan ng performance namen as probi

pasok po ba etong dun.

Section 6(d) of the Implementing Rules of Book VI, Rule VIII-A of the Labor Code

Sec. 6. Probationary employment. – There is probationary employment where the employee, upon his engagement, is made to undergo a trial period where the employee determines his fitness to qualify for regular employment, based on reasonable standards made known to him at the time of engagement.
Probationary employment shall be governed by the following rules:

x x x x

(d) In all cases of probationary employment, the employer shall make knownto the employee the standards under which he will qualify as a regular employee at the time of his engagement. Where no standards are made known to the employee at that time, he shall be deemed a regular employee.

Tanong ko po si pwede ba namen na iapila na invalid ung probi namen but instead regular na kame from the time ngstart na kame...
Wala po kasi standard na dinuscuss samen.. wala po kameng scorecards at kht attendance po ay hnde bnbgyan ng score as in wala pong standard na basehan kung panu kame pumasa basta ung evaluation form lang na binigay samen un lang po and we saw that 3 months pa.. kasi stated on the labor code above na dapat meron at dapat dinuscuss samen bago kame ngstart sa new role namen...

Instance po kasi ung mga nauna samen hnde dumaan ng probi tpos ung mga sumunod samen hinde dn dumaan ng probi...

Ok lang sana saken kung standard eh kaso prang hinde at ngsisinungaling kasi ung HR about sa status nung mga nauna samen at sumunod samen.. Sila pa mismo ngopen pero hindi nila sinasabi lahat..Hindi sila transparent..

For example ung mga nauna samen wala namn daw retro pay kundi adjustment kasi nadelay lang ung increase ng sahod nila pero hinde nia sinabi saken na hnde pla sila dumaan ng probi.

Tpos ung mga sumunod naman samen eh Probi daw pero wala silang letter ng pagiging Probi pero 2 months na sila ngwowork. Ang sabi ung letter daw meron pero hnde pa nagagawa kasi busy daw sila...

What the labor code defines is the probationary status from the time when you are hired until you become a regular employee. It is not applicable for promotion since PROMOTION and DEMOTION is a management prerogative. You can question your HR but if I were you, just enjoy the promotion and move on with the retro pay. If your given then good, if not then just let it go. It is not in the labor code that the management must give increase once it promotes an employee. Questioning the management for such little amount may do you more harm than good.
