need ko po legal advise about fraud or dishonesty daw as per company policy

HI atty! I am currently working at a BPO company, nagkaron po kc ako ng Notice to Explain memo nag nagfafall under fraud or dishonesty daw sa company nung march 15, 2014 because of changing the number na ineenter ng customer when they`re calling us sa sytem namen na (CTI) na nakakaaffect pala sa FCR (first call resolution) which is 45% ang weight sa performance namen para magkaron ng MONTHLY INCENTIVE PLAN bonus every month which is ndi po ako aware until they cascaded it to us last FEB 08, 2014, wala naman disclosure sa data na naudit nila skin na chinchange ko ang number nung DEC and JAN which is before they send the disclosure info na nakakaaffect pala un pagpinalitan namen ung number na naenter ng customer e tataas ang score sa FCR para magka monthly incentive plan bonus I admit na pinapalitan ko un for the sake of our CSAT scores which is 10% ng MIP (monthly incentive plan) na ndi naman ako eligible, naaudit nila ung mga change number nung DEC and JAN pero nakalagay sa NTE ko e FEB 11 pa nalaman na ginagawa ko un pero pinareceive lang nila un skin nung March 15, 2014 kung nagfraud nga ako bat[b] Feb 11, 2014 pa nila nalaman pero March 15, 2014 lang skin pinaexplain? and there was no preventive suspension because ndi ko na pinalitan ung number nung customer which is bawal from the date they cascaded it to us? sabe skin may pareho na case pero natanggal na, termination kc daw po nakalagay dun, I hope u can help me out po salamat ng marame!!

So far from what I have read, you may be liable for fraud and dishonesty by tampering or changing the already entered data for previous months, no matter for whatever reason you did it (CSAT or any others).

There may be a delay from Feb to March from discovery to notice in order for them to review all items carefully to determine if there is any liability on your end.

Any preventive suspension is up to the discretion of management.

kung fraud po iyun na nalaman nila nung feb 11 then bakit po pinatuloy pa din nila ako pinagtatake ng calls up until today? kung alam nila na mali naman pala un at pagiging dishonesty pala po iyun? ang sabe intention ko daw po ay monthly incentive plan which is ndi naman ako eligible doon?

Then you have your chance to explain when the hearing comes up.

As I said, any PS is for them to decide. And one reason why they allow you to take in calls even after Feb 11 is to see if you still continue to do it.

does it mean they`re giving me a chance? o for investigation purposes? desperado po tlga ako na ndi ako materminate dahil mahirap maghanap ng work lalo na pag pregnant na katulad ko, sa palagay nyo po ba termination agad katapat nito? sa opinyon nyo lang po naman salamat po!

Habang nag-imbestiga sila, they gave you a chance to see if itutuloy mo yung fraud at mag manipulate ng stats.

Ngayon you have to go through the hearing process.

Alam mo nang mali, ginawa mo pa din, kahit ano pang dahilan yan.

And yes, terminable yang offense. Mahirap patunayan na hindi sinadya ang ginawa.

hindi ko po alam na mali ang ganun, until na cascade po sa amen nung feb 08, 2014 sinabe po na terminable un starting feb 08, 2014 ung na audit po sa akin ay noong dec and jan which is before the date na nalaman ko na nagrereflect pala eto sa fcr 3% of my calls ang nakuha nila na naudit for two months. starting in feb 08 ndi ko na po ito nagawa may mga instance po na inamin ko na nagawa ko yun nung dec and jan dhil ndi naman ako aware na terminable po iyun at mali po tlga un, ano po bang magandang iexplain ko sa hearing ko bukas? salamat po!

sinabe po skin ng tl ko na just be honest sa hearing at mag commit and apologize un din ang nilagay ko sa explanation letter ko naging honest lang po ako at nagsabe bat ndi ako dpat iterm kc lack of disclosure of information at ang sinabeng intention ko ay malayo sa nangyare dhil ndi naman ako eligible sa incentive plan for those months

Wala bang consequence ang pag palit ng stats? Kung walang kalalabasan ang pag palit ng stats kahit saan, kung walang pakinabang sa iyo ang pag palit ng stats, bakit mo pa din ginawa?

If any company policy is silent, or if it is not clearly stated, the labor code still kicks in and applies. Fraud and serious misconduct pa din yang ginawa mo.

ART. 282. Termination by employer. - An employer may terminate an employment for any of the following causes:

(a) Serious misconduct or willful disobedience by the employee of the lawful orders of his employer or representative in connection with his work;

(b) Gross and habitual neglect by the employee of his duties;

(c) Fraud or willful breach by the employee of the trust reposed in him by his employer or duly authorized representative;

(d) Commission of a crime or offense by the employee against the person of his employer or any immediate member of his family or his duly authorized representatives; and

(e) Other causes analogous to the foregoing.

sana nga po hirap kc ng situation ko with my second baby ko sa pregnancy ko as a single mom and breadwinner pa ako ng family ko kaya naghahanap ako g tamang solusyon na possible na magsave skin bukod sa pagiging honest, ano ba maganda na explanation? tama lang naman na naging honest ako dba? sabe ng kausap ko na attorney sa isang site wag dw ako aamin napasa ko na ung explanation umamin naman ako pero ibang intension naman tlga iyun and it wont still qualify me from getting the mip target kahit ipasa ko pa lahat ng metrics or goal namen or scores due to my LOA because of risky pregnancy.. sana po mapayuhan nyo ako ano maganda gawin bukas na kc hearing salamat po!

Being honest helps. Pero hanggang doon ka na lang and hope na bigyan ka pa ng pagkakataon.

Pag uma-attend ako ng hearing, pag tapos na ang lahat ng usapan at pagpapaliwanag at pakitaan ng ebidensya, tinatanong ko lagi - since terminable ang offense mo, why should we give you a chance and retain you? And what is our assurance that you won't do it again?

Answer that well and you might have a chance.

ang sasabihin ko sa hearing pag tinanong yan, I am a single mom and pregnant with my second baby I wont do anything to compromise my job because I cant lose my job and I assure that I wont commit the same mistake or anything against the policy of the company

Hi ask ko lang po pinagtatake pa din po nila ako ng calls up until today 2-3 weeks daw ang decision sa palagay nyo po ano po kaya mangyayare? ndi naman ako nalagay sa preventive suspension?

Depende yan sa kung ano ang sinabi mo sa hearing at kung maniniwala sila sa sinabi mo.

oo nga po ndi na ako na PS sabe lang skin 2-3 weeks, kung ang decision nila e term just in case may laban po ba ako dito since ndi naman nila ako na ps.. salamat po!
