Good day, Attorney/s!

My wife was employed in Telus year 2009. Pero training period pa lang, nag-AWOL na siya kasi nagkaroon ng problem between her and her mentor. So hindi siya naging Regular Employee.

Then she worked at SiTel for 2 years, 2009-2012; then she worked at WiPro year 2012-2013; then she worked at CVG year 2013-2014.

1st week of January 2014, nag-resign siya sa CVG. 2nd week of January 2014, she received a call from Telus, inviting her for an interview. She was asked for an updated Resume and an NBI Clearance. Kinabukasan after tumawag ang Telus, my wife went to Telus.

Sa Resume niya, under Employment History, Nilagay niya ang Sitel, WiPro and CVG kasi naging Regular Employee siya. Hindi na niya inilagay sa Resume yung Telus since training period lang pinasukan niya at hindi siya naging regular employee.

1st interview, nakapasa siya. Before 2nd interview, kinausap niya ang HR, at sinabi niyang employee siya dati ng Telus pero matagal na at hindi siya naging regular employee. Sabi ng HR na nag-aassist sakanya, "Its ok, Just put the number 2 sa dating email mo and then mag-exam ka na tapos final interview na."

Naipasa niya lahat ng exams and interviews. Binigyan siya ng 1 week para ma-complete requirements na hinihingi nila like NBI Clearance,.. Pinag-sign siya ng contract after a week.

Here comes the training period. 1 month of training period. 1 week before the graduation of training period, binigyan siya ng HR ng Incident Report and Due Process Form dahil daw sa "Misleading and Falsification of Documents", dahil hindi daw niya sinabi sa resume na galing siya ng Telus noon. Kinausap niya ang HR, sabi niya, she declared it before the 2nd interview sa HR na nag-asikaso sakanya, at ang sabi ok lang, just put number 2 sa dating email niya, wala lang sa resume niya kasi hindi siya naging regular employee so parang useless pero SHE DID DECLARE IT SA HR. Kinausap yung HR na nag-assist sakanya at inamin naman ng HR na yes, she declared it before the 2nd interview. Sabi ng HR, sa hearing na lang daw siya mag-explain.

1 day before their graduation, kinuha ng Telus ID niya at sinabing for Termination na siya. Dahil nga daw sa Misleading and Falsification of Documents. Kinausap niya ulet ang HR, kasi akala niya magkakaroon muna ng hearing. Sabi ng HR, "Madami din kasi nag-aapply ngayon, kailangan namin mag-bawas". So its clear na excuse lang yun at hindi yun ang reason.

My wife filed a grievance coz she thinks the decision is not fair.
1) On the first place, Telus ang tumawag para mag-apply siya, at hindi siya ang pumunta dun para mag-apply. Dun pa lang, ineexpect na ng wife ko na mayron ng info about sakanya ang Telus.
2)Second, sobrang daming requirements ang pina-asikaso sakanya at nag-aksaya na siya ng time and effort sa training, 1 day na lang eh mag-start na sila sa floor.
3) 3rd, she declared sa HR una pa lang na dating employee siya ng Telus pero sobrang tagal na. At inamin naman ng HR na nag-assist na sinabi nga niya yun before 2nd interview.
4) Binigyan siya ng Due Process Form to explain her side, pero wala nang hearing ang naganap.
5) "Madaming nag-aapply kaya kailangan mag-bawas" is not an acceptable reason na galing sa HR.

1 month na nakalipas, pero wala pa ding follow-up sa grievance na ni-file ng misis ko. My wife keeps on texting Telus, pero wala na sumasagot. Bigla na lang nagtxt ang Trainor niya na Term na siya.

Ano po pwede naming gawin? Pwede ba kami magfile against them sa DOLE? May laban po ba kami?

Kanino nag file ng grievance ang wife mo? Sinong HRBP ang may hawak ng case nya? Usually 2-3 days lang yan for a decision ng grievance.

As long as the case is not yet closed, your wife still has a good chance of clearing herself properly in this matter.

As long as the case is not yet closed, your wife still has a good chance of clearing herself properly in this matter.

Sa mismong HR ng Telus po siya ngfile ng grievance. Sa Incident Report at Due Process Form niya kasi may kasamang paper dun kung gusto magfile ng grievance.

1 month na po nakalipas, wala pa din decision for grievance.

Nagtext lang yung trainer niya na terminate na siya at wala na daw siya habol sa na-file niya.

Panu po namin malalaman kung closed na yung case? mahigit 1 month na po nakalipas since nagfile siya ng grievance. Nagtext lang yung trainor niya na term na siya at wala na daw siya habol.

Ano pwede namin gawin para ma-close na nila yung case?

Maraming HR ang Telus. Baka sa recruitment lang sya nag file ng grievance, talagang walang mangyayari dun.

Ano account nya and name ng trainer? Ask mo na din name ng HR.

Standard template ang DPF nila and ang usapan tungkol sa grievance nangyayari lang pag meron nang decision sa kaso.

The only way to know that it is closed is when a decision is given to your wife personally or via registered mail.

Then grievance procedures follow.

Then final decision by HR.
