22 years na po ang co. na pinapasukan ko. Bukod po sa Incorporators ng co. na may members ng board, wala pong ibang opisyales ang kumpanya. Nito lang po 2008, ay nagkagulatan na lang kami na nagkaroon ng Managers. Itinalaga ang nag-iisang Senior Proj Engr. as Operations Mngr, ang naiwan na unlicensed accountant na Finance Mngr. at ang obviously na paboritong secretary as Personnel/Purchasing Mngr. SINCE then, ang ipinangako sa amin na PROFIT SHARING ay nawala. ang claim po ng Finance Manager namin ay NAGBAWAS PO RAW DIUMANO ANG MGA STOCKHOLDERS NG KANILANG SHARE para maibigay sa kanilang tatlo as INCENTIVES bilang managers. May paraan po ba para malaman namin kung totoo ang claim ng finance manager?
PANGALAWA po, ang aming Personnel manager ay matagal nang nagreresign- pero di payagan ng President, kaya po madalas ay nagBABAKASYON ng 2mos o higit pa para bumisita sa kanyang mister na nsa Saudi, KAMI PO P NA PANGKARANIWANG EMPLEYADO ay pwede ring i-grant ng ganun bakasyon (w/o pay of course)

sorry to say, it is the employer's prerogative to manage the company the way they please. you cannot request the financial info as a right.

is this promise of profit share in writing? unfortunately, even if you could prove that there was a promise, if it never commenced or subject to a condition, then it will be very difficult also to claim it as a right.

it sucks, i used to work in a company too. but it is perfetctly reasonable for the employer to take the position that you can take it or get out.

upon resignation, will the unused VL be paid? is there a provision in labor code about this?

moderator
the law only provides service incentive leave which is monetized at the end of the year. you will have to prove that vl's are monetized and given to resigning employees as a policy of the company to claim it.

ang aming cooperatiba ay nag bibigay nag 15 sl-15 vl na nakasaad sa aming emplyees manual, at naka lagay pa duon babayaran ang anuman hindi nagamit na mga leave. ang policy po ng leave after 1yr po na maregular makaka avail na ng leave. ang problema po na one yr na po ako as regular employee wla pa ako leave at another 1 yr pa daw para sa buffer. ni hindi naman ito naapprove ng mga board. may habol po ba ako para makuha ko ang leave ?
