Good day po,

Under po ako ng agency, 8 years na ko nagwowork dun sa pinagdeploy-an sakin. Ngayon po, magreresign na ko sa agency, kasi lilipat sana ako sa ibang department nung company na may offer na regularization. Sinasabi po ngayon nung department na ihohold ako sa HR, para hindi ako makalipat sa ibang department pero same company. May 1 month notice naman po ako. May karapatan po ba silang i-hold ako? para hindi makalipat sa ibang department? Nag-woworry po ako, baka masayang pa yung oportunidad.

usually kung agency yan hindi ka talaga pwede lumipat agad agad don sa company na inassign sayo kahit iba pang department yan.. basahin mo yung contract mo..

wala naman po sinabi sa contract ko na ganon.. pwede naman daw kami i-absorb nung company.
hinaharang lang ako nung department head, para hindi makalipat sa ibang department.

Hello po! Hope you guys can give some advise. We are on the last month po for regularization. Ang nasa contract namin ay after a year of stay sa company, saka pa lang namin malalaman kung ano status namin. Yung company namin ay bagong start lang sa Pinas Last June 2013. Contract for 1 year po yung pinirmahan namin kasi gusto ni employer i-try kung magiging magnda ang pag start ng company sa bansa o hindi, pra kung hndi maging maganda ang result, pwede nila pull ot ang company nila. Tanong ko lang po kung posible po ba na hindi kami iregular in case na ituloy ni employer ang company sa bansa? Kung renewal of contract, wala naman po ba masasagasaang batas ng Pinas? Gusto ko lang po malaman ang advise nyo na nasa legal industry. Maraming salamat!

pwede i absorb.. pero the company needs to pay the agency.. pero kung lilipat ka basta basta.. syempre hindi papayag yung agency.. kailangan kumita sila..

Thanks for the advice! Pero, possible din ba na hindi irenew ung contract? If yes, possible ba na hindi irenew contract and then no advise a month before ung last day ng contract?

read your contract.. dapat sabihin sayo 1 month before kung hindi ire renew..

Yeah. yun din ang alam ko at yun din ang nakalagay sa kontrata na 1 month before iaadvise ung staff regarding sa status. Posible po ba na hindi kami i-absorb? As contractual staff, may laban po ba kami kung sakali man hndi kmi irenew ung contract/iregular without even advising us a month before? Need your advice guys. Salamat!
