Arresto Menor
I am Dennis William I Dolino a red of Pob 3 dapdap CarCar City, Cebu.
I would like to seek your legal council and advise in regards to a case we are trying to file.

My brother in law has been stealing stocks from my inlaws metal work products. It jas been 2 years since he has been doing it and may have stolen half a million pesos worth of their cash, products and materials. My in laws have reprimanded him many times and he has responded to them with hostility threatening to kill them and in the other week when my father inlaw caught him in the act and was reprimanded yet again he attacked my father in law and threw stones at him causing him injuries. My father in law reported it to the police but all they did was tell my father in law to call them back if he ever does it again.
Last friday May 23,2014 We caught him stealing worth 15 thousand pesos worth of products and brought it to a different house. We reported it to the police and recovered the stocks.
The suspect was then at my in laws house so we asked the police to arrest him there but the police refused they said it is against the law to arrest a suspect inside the house. They asked my 70 y. O in law to go ask the suspect to get out of the house. With fear they asked to be escorted but the police refused still saying they will just come back in the morning when the suspect gets out of the house. So I volunteered to call out the suspect. They then gave mw handcuffs so I could use it on the suspect but I refused. So I drawed the suspect out and luckily I was able to subdue him. The police then came and took him. In the station upon their investigations they asked me to take pictures of the stolen items. I thought that was their job?
Also I noticed that they kept discouraging my inlaws to file a case stating they should just forgive him. They also stated that the law does not allow parents to file cases against their children and the fiscal would only dismiss the case. They also would not allow my father in law to be the complainant what I did not get as well is they asked us to take the recovered evidence with us.

The case is now with the fiscal. He did say that he will have this pushed through but I hear from the police that the fiscal would only dismiss the case since the accuse is the son of the complainants. We actually have additional cases we want to file such as physical injuries and grave threats. The suspect last week was caught by his father stealing and was reprimand but he threw stones at his father and hit him instead. He constantly threatens his mother that he will kill her.
The suspect is a known drug abuser. Please advise on how we would have him detained foir good for he is a threat to the family financially and physically . Thank you and more power!
