Hi,
Good day. What if two attorneys has been given special power of attorney to act as agent only – but the clause of the SPA states that they are allowed to sell it on behalf of the owner.
What happened after is that they were able to sell it and they did not advise the owner. Worse is that the owner died this January and the details of their agreement was left on the siblings.
Is there any legal action that we can do with regards to this case?
Please help us.

the power or validity of the spa dies with the one who issued it, you can contest the sale made if the owner died before it was finalized

pakiclear po. nabenta na ba ang property bago namatay ang ng issue ng spa?

after the sale, doon pa namatay ang owner/issuer ng spa?

kasi if buhay pa ang owner (nagbigay ng spa) at the time of sale, valid iyong sale na iyon.

sale has been done without the knowledge of the owner - buhay pa sya nun. pero nalaman ng binentahan na hindi alam nung owner (our mother) kaya hindi pa nya nabayaran ng buo.

ano po bang legal process dapat gawin dun, kelangan po ba harapin namin ung lawyer (na hindi na rin namin makontak) o diretso na magfile ng complaint against them?

tumingin ang father ko ng second hand na sasakyan thru online ads. then, nagpaunang bayad sya ng 10,000.00 para dun. Kinabukasan nang tiningnan ko ang sasakyan at sana eventually babayaran na, napansin ko na may problema ang makina, kaya nagdecide ako na wag na ituloy ang pagbili. Pero ayaw ng ibalik nung may ari yung 10,000 dahil naabala na daw sya at kung hindi daw sana nag commit ang father ko eh dapat daw naibenta na nila sa iba yun. Tama po ba na hindi ko na makuha yung pera? Please help po.
