Hi,

Hi, I would like to inquire about my job being terminated due to absconding. They ended my employment last Jan. 09, 2014 because of my absences without notice for Jan. 6-9,2014. Wherein I advised that I wont be able to attend my shift until the 15th of Jan through email since I dont have my phone with me. I got the news that Im already terminated so I went to the office on the available time for me to clear everything but they told me that Im already tagged as TERMINATED. I dont even get a letter for admin hearing for my termination case. I understand that due process still needs to be serve in accordance to dismissal. I tried coordinting with then multiple times but still not getting clear response. I waited for the RTWO since it is for due process but haven't got any letters from them.

Now, the biggest part is I haven't filed the complains yet to NLRC and now I received the FIRST and ONLY letter from my employer informing me to settle the outstanding financial obligation.
**Reasons are Overpayment of final salary and cost allocated for training and upskilling for failure to render 30days and failed to return company assets.

First of all, I tried to coordinate with them regarding this issue. I even asked them if I can just resign to clear everything but they told me that Im already terminated.

I am looking forward for your legal advise.

After a month with this case, di sila sumipot sa SENA at nagfile na ko ng complaint to Arbiter. Sa first meeting sa Arbiter, di pa rin sila sumipot at may 2nd hearing pa, hoping na sisipot sila to finalized this. However, ask ko lang what if di pa rin sila sumipot. What legal action do I have and would that cost me?

I just want to ask since hindi umattend ung company sa sessions namin sa NLRC, now is requesting to submit the position paper. The problem is that PAO denied my request since it is only applicable to those whose net salary is Php14,000 below.

My question is, can NLRC accept the Position Paper without the signature of an attorney? Since I cant afford one.

Yes you can file your own position paper, but in the required format.

Kung ikaw ay talagang may sakit, walang magagawa ang iyong kumpanya. Ihanda mo ang iyong medical certificate. Pag gumaling ka pumasok ka just like before. pag hindi ka pinapasok at inalis ka o na dismiss ka ...file ka ng kaso sa NLRC para madagdagan ang kaso ng tinamaan na magalingyang kumpanyang yan.

hello. i just have an inquiry,i hope someone can help me out .im a probationary employee, i was hired as a sales supervisor in a BPO. it was stated under my contract that ill be supervising my team but after my training they assigned me tasks that was not related with my job description. everyday i take calls pushing for sales,aside from that i do marketing and also Monitor calls and do QA reports for the agents in a daily basis,pretty much jack of all trades.they dont provide any progress report in documents that has the signature of the management so i was not aware about my performance,everything is verbal in our company.so i dont have an idea aswell what is my role in the company but the only thing i know is that they hire me as a supervisor which is to supervise my team. and after that they assigned me to make all the training materials for all their accounts which was really hard to do and after that,every meeting they are looking for my sales, why am i not getting any sales,which at some point we didnt agree for any quotas or target when it comes to sales because i was not hired as a agent,it was not stated on my contract. and after that i was forced to resign by my boss and i told them why would i do that.they told me i was not performing considering that there was no  clear cut description of my duties. not even a single documentation about it but i was able to do their training platform and QA monitoring at all times and i have it documented for my own protection. so they gave me my termination paper instead without any reason or legal proof i was not performing. they didnt give me a copy of my contract aswell CAN I FILE A CASE AGAINST MY COMPANY? because it really made me so depressed and anxious and even triggered my gastritis to worsen due to stress ..tnx i hope you can give me the best recommendation because it is so humiliating specially if there is a gray area with the task that was given to me. tnx

jheckie: before thinking of filing a case against your company, please consider your employment status for now (probationary). Meaning, it may affect your employment if you undertake such an action, it would have been different if you are already regular employee , then you have a security of tenure and management cant just fire you left and right.

Being probationary entails sacrifices for finding work these days are so difficult and very competitive.

Being a sales supervisor encompassed a very broad range of responsibility coming from the word itself -- to supervise -- the task involve overseeing a multifarious function pertaining to operation and also as what your contract provides.

Why not take the matter first to your immediate head and clear all the uncertainties with respect to your duties and responsibilities before deciding steps leading to legal action.

Good evening po sa inyo. Sana po ay mayroong makatulung sa amin ng kapatid ko.Ang kapatid ko po ay nagtratrabaho sa isang hotel sa Makati. Na-terminate po siya, kasama ng iba pa niyang co-workers sa hotel pinagtatrabahuan nila sa kadahilanang nadamay sila sa kasalanan ng Supervisor nila, na napag-alamang nag-nanakaw ng pera sa hotel.

Ang sabi sa kanya ng Manager nila, desisyon ng mayari ng hotel na tanggalin lahat sila dahil nawala na yung tiwala sa kanila ng company. Hindi po sila nabigyan ng due process, at ayaw na rin po silang bigyan ng Certificate of Employment ng hotel na pinagtatrabuhan nila.

Meron po bang expert dito sa Labor Code? Hindi ko po personal na maalalayan ang kapatid ko dahil nasa ibang bansa po ako. Sana po ay may makatulong sa amin. Maraming salamat po.

The respondent submitted a letter of appeal. Do I need to respond to it? Or I just need to wait for another decision? I really appreciate your response since I can't afford a lawyer and been striving to resolve my case by myself. Thank you

moderator
ideally, you should file a response. you have 10 days after you received the appeal memorandum. check if they filed a bond for the monetary reward. this may also be an opportunity for you to negotiate a settlement.
