Theft in Condo - is bldg owner / management liable?

Hi Atty,

Need your advice please. Nanakawan kami sa condo unit na nirerent namin last Tuesday (June 24), may signs of force entry kasi may marks yung door knob at yung kahoy. May cctv yung condo pero mukhang nag malfunction nung araw na yun at walang recording (we are still waiting their IT na marecover yung recordings).

May chance ba na mapabayaran namin sa building owner (sila rin owner ng unit) yung mga items na nanakaw samin? Kasi yung condo namin sa gabi lang may security guard at sa umaga mga admin lang ang nagbabantay. May mga incidents na naiiwan nilang bukas ang gate at minsan wala sila sa ground floor para magbantay kasi pinaglilinis din sila ng bldg. Pag sinampa ko ba to sa court may chance akong manalo? Malaki-laki kasi yung amount ng mga nawala samin  Sad

Ano ang sabi sa lease agreement ninyo? Meron bang nabanggit tungkol sa security sa mga papeles na pinirmahan ninyo?

meron pong clause sa contract regarding injury or damage

"INJURY OR DAMAGE

The LESSOR shall not be liable for i) the presence of bugs, vermins, ants, termites, insects, if any, in the Leased Premises; ii) the failure of water supply and/or electric current; iii) any injury, loss or damage arising from the acts or negligence of the LESSEE or its agents, employees, representatives or any and all other persons."

pag ganito po ba wala na kong habol?

Baka meron kang habol kung mapatunayan na ang loss or damage ay hindi dahil sa inyong kagagawan or kapabayaan (negligence).

sir, bale naghearing na kami sa barangay and ang defense nila is nag-advise daw sila samin na maglagay ng double lock kasi hindi provided to ng building. bumili wife ko ng lock tapos nagsabi kami sa kanila na magpapakabit kami, at sabi nila wala pang available na karpintero hanggang sa umabot na ng 2 months wala pa rin. since 6 months lang kami magrent and 4 months to go di na kami nangulit sa kanila magpalagay ng double lock. Negligence po ba on our end yun?

tiyaka hanggang ngayon wala pa rin yung cctv footage.

Yes, it may be negligence on your end.

Check your contract kung ano ang nakalagay na pwedeng gawin ninyo na mga construction or repair sa inuupahan ninyong condo unit. Kung nakasaad na pwede kayong gumawa ng minor repairs or installation at inasa nyo sa kanila na gumawa, baka nga meron din kayong pagkukulang.

"THE LESSEE shall not make any alterations or improvement on the Leased Premises without the written consent of the LESSOR. THE LESSEE may remove all alterations or improvements made with the consent of the LESSOR as long as these do not deface or injure any portion of the Leased Premises."

wala kaming nareceived na written consent pwede ba yun? kung negligence on our part to, may negligence din ba sa part nila kasi nakapasok sa gate ng condo at nasa 2nd floor unit namin. tiyaka may cctv sir pero wala ring nagbabantay, tapos wala ring security guard sa umaga. sa tingin niyo po?
