Hi to all attorneys, legal adviser & concern citizens,

I have a sister working in Middle East, she is seeking legal advice regarding with his son's financial support from his father whoís currently migrated and working in US for
almost 4 yrs. Well, they are not legally married but in birth certificate they both signed as the parent of the child and the surname of the child were followed after his fatherís surname. My sister and the father have still communication through internet
for them to discuss the matter regarding on their son, the father are not regularly sending money to his son which under custody of my mother and already 14 yo. So basically, what will be my sisterís action in this kind of situation if the father doesnít want to support his son financially?

does the father visit the philippines from time to time? is he a registered OCW?

Hi attyLLL,

I believe no! The last time he visited Philippines was last year and for OCW or Overseas Contract Worker matter, well on that part I have no idea if he was registered or not because as I far as I know the father was petition by her mother to live in US and of course to earn money, so he looked for a job in that place.

you can send letters to the father demanding support. if he does not provide, then you can file a case of economic violence. but the case may not continue if he is not here. however, he might start providing just to avoid a case. or the case continues, and if he steps into the philippines, the warrant of arrest can be enforced.

the better remedy is to file a case in the United States for support, but I am not competent to advice you on that.
