Hi,
Legal Advice naman po. March 15, 2014 (3 months ago) since nag file ako ng resignation. Pero hanggang ngayon hindi ako pinapayagang umalis ng wala akong kapalit. Pwede na yun? At Nasa batas ba yun? Ayoko naman magAWOL sayang naman yung 3 months na tiniis ko. At paano kung walang mag-apply edi hindi na ako makakaalis? Help po. Sad

Basta nag advise ka at least 30 days in advance, pwede ka na umalis.

Ano ang nakalagay sa resignation letter mo? Ano ang sagot ng company or ng manager mo?

Hindi ba ako maaAWOL kung aalis nalang ako? Makukuha ko pa ba yung last salary? I've passed my resignation letter 3 months ago na walang effective date. May habol pa ba sila dun? Since 3 months na rin naman ako nagstay? Ngayon gustong gusto ko ng umalis pero laging sinasabi ng boss ko na hintayin ko daw yung kapalit ko. Natatakot naman akong umalis bigla baka masayang yung 3 months na tiniis ko para lng ma-cleared ako sa company na yun, first job ko pa yun.

Kung aalis na ba ako makukuha ko pa ba yung dapat kong makuha? Iki-cleared ba nila ako sa company kung sakaling hindi na ako papasok? Hindi ba nila iho-hold yung last salary ko, COE at magagamit ko pb yung name ng company as work experience if ever umalis ako kht ayaw nila?

Pero sabi sakin ng HR kung maAWOL ako may karapatan daw ang company na I-hold the ff: last salary, 13th month pay, COE. Paano po yun? May legal action po ba para dun? Sayang nmn yung pinaghirapan ko kung hindi ko makukuha dahil lng ini-insist nila AWOL ako. Sad

Kasuhan mo ng non-payment sa DOLE/NLRC.
