Good day atty! I'm so glad to have across with this website. I really find it so helpful especially to those people who don't have much knowledge about the law.

Eto po ang gusto ko i kunsulta sa inyo, kame po ng family ko ay nakatira sa isang compound, tatlo pong pamilya ang nakatira sa compound na kung saan tabi tabi ang aming bahay at may lagusan para makapunta sa kanyan kanyang bahay. Meron po nakatira sa kabilang bahay na 16 year old na lalaki. Ilang beses na po kame kinukupitan at ninanakawan ng gamet, pagkain at pera. Bata pa lang po siya nag simula mangupit. Pa unti unting halaga. Hanggang sa umabot na sa 100, 500,1000 ang kinukupit. Nung una po ay sinasabihan lang namen siya na masama iyon sa pag aakalang di niya gagawin muli ang pag omit ng pera. Pero sa tuwing nakakatyempo po siya na walang tao sa kwarto namen, muli po uli siyang nagnanakaw. 7,000 po ang pinaka malaki niya nakuha. Ilang beses na din po naming nahuli siya sa akto na binubuksan ang bag ng nanay ko. Atty, paulit ulit na po niyang ginagawa ito. Nakakalungkot mang isipin na parang hindi kame safe sa sarili nameng bahay. Gusto na po namen mag sampa ng kaso, kaso ang iniisip mo namen ay menor de edad pa siya. Pwede na po ba namen siya pahuli at ipakulong? Sobra sobra na po kasi ang ginagawa niya sa amen. Ano po ang mga legal actions na dapat gawin para mahinto na po siya sa pagnanakaw sa amin. Salamat po and more power.

moderator
your first step is to report to the police to have it recorded (blottered). then you can either file your complaint affidavit directly to the prosecutor's office or a complaint to the bgy first (not required because of the amount).

at 16, he is not exempted from criminal liability but it has to be shown that he acted with discernment (alam niya na mali). as a child in conflict with the law, he will be entitled to be released to his parents or the dswd while the case is ongoing.

what about the child's parents? what have they done about this?

Thanks for the immediate reply. Hindi po niya kasama ang parents niya. Hiwalay na ang parents niya. Sa ibang bahay po nakatira ang nanay niya na kung saan dinadalaw niya minsan. Ang kasama po niya sa bahay ay guardian lang niya (kapatid ng nanay niya). Pero kahit sa guardian po niya di na siya nakikinig. Alam po ng bata na mali ang ginagawa niya dahil minsan pong nahuli namen siya, nag iwan siya ng sulat sa amin at nag sosorry at wag daw siya isumbong sa guardian niya kasi papagalitan siya. Pero paulit ulit pa din niya ito ginagawa. Pwede din po iyun magamit na ebidensiya proving na guilty po siya diba?

Pag nag report po ako sa police office, ano po ang mga kailangan para maging valid ang pag sampa ng case?

the note can be evidence.

before going to the police, make a list of the instances you caught him stealing and itemize what was stolen. the persons who actually caught him plus the owner of the stolen items have to go together.
