My mother is spending our inheritance... need advice

2 years na po wala dad ko at 5 po kaming naiwang magkakapatid at ako ang panganay, hanggang ngayon ay hindi pa rin po inaasikaso ng mommy ko ang mga ari-ariang naiwan. Nabalitaan po namin nakapagbenta na siya ng lupa at nakapagbukas pa ng bank account na nakapangalan sa kanya at sa pangalawa kong kapatid. Nitong nakaraang buwan may nakita akong sobre na galing sa bangko at may lamang mga tseke na na-issue na at panay gastos nila ng kapatid ko pero hindi magawang lakarin ang mga dapat lakarin para mailipat na sa amin ang mga titulo. Ano po ang dapat gawin?

are u of legal age? how old are your siblings? better discuss your concerns first with your mother and other sibling who seems to be aware of the inheritance. in so far as the law is concerned, you of course have the right with whatever your father has left behind. better sit down first and discuss your apprehensions and it would be best too if their is a lawyer who can guide u on how to go about the inheritance

yes, we are all of legal age... yung youngest ay 23 years old. Worried kami kasi halos lahat ng properties ay namana ng father ko sa parents nya kaya hindi conjugal property yun. Halos araw-araw umaalis mother ko kasama yung pangalawa kong kapatid kasi busy sa organization nya. Wala naman cya work and ang ginagastos nya from gasolina ng sasakyan at iba pang gastusin ay galing sa income ng mga paupahan.

you and other compulsory heirs of your father must execute a deed of partition (extra=judicial) or seek court's intervention put the property in custodia legis until a decree of partition is issued (judicial).

how about po sa mga rentals naibayad ng mga tenant at nagastos nya for past 2 years? hindi po ba mabibilang yun sa magiging share ng mom ko? sa pagkaka-alam ko halos naubos na yung pinagbentahan ng lupa nitong january lang Sad

that would be counted as part of her share to the inheritance. that would be deducted from her share once the partition has been finally decided upon.

Thank you po sa mabilis na reply. Pano po ang dapat na hatian? lagi po sinasabi ng mom ko na dapat 50% sa kanya plus 1 share pa sa the rest. Nag-research po ako sa net at kinasal sila before Aug 1998 kaya sakop pa sila ng New Civil Code. Majority po ng properties na na-acquire ng father ko ay galing sa mana from his parents. Considered po ba na conjugal property ang namana o exclusive property?

inheritance is an exclusive property of the decedent. therefore, your mom cannot have automatically the 50% as conjugal/common share.
