Is qualified theft worth 280k is bailable? how much the bail? my frend have a warrant to arrest. kasi d xa naattend s subpoena s knya. may incident kasi nwla s compny nla e 2 lng cla may access pero ung 1 ay in absent lng ng head xa meron access at wlang audit inventory nangyari b4 humawak ung reliever. Frend q tlga ang vault custodian branch head. one day absent ang frend q, may nlaman nlng ang reliever n may nwwla n item s compny nla at ipinaalam nya ito s frend q knabukasan. Sv ng frend q na wag munang svhin s manager at nandyn lng yon s loob at nabuhos ang mga julahas. later, snv ni reliever kay manager ang nangyari at ung frend q nagkasakit nang cancer so ngfile frend q nang resgnation letter advise ng dok nya. itong reliever nmn dretso ng pasok s compny pero d n xa authorized s vault. hanngang nasuspended sa nrcvd nya na fake na alahas at nagsumbong s dole at illegal suspension gnwa s knya. After audit lumbas n may major major n julahas ang nwwla at knasuhan clang 2 ng qualified theft? Ung frend q lng b dpt ang managot s nwwla at xa nmn tlga ang branch head vault custodian at kpg absent lng xa e sk lng nkkpsok s vault ung reliever. Cguro 10x nkaabsent ung frend q.

Atty help nmn panu ggwin ng frend ko? Panu ang ggwin pra makpag bail xa? NO BAIL recommended ang ns warrant.?

Paano po ang maaring gawin para makapag bail kasi wala naman silang evidence para bigyan ng warrant to arrest ang frend ko.?

Sa ngaun po e nakakulong na ang frend ko..

if there is already a warrant of arrest, i don't think you can say that there is no evidence. it means the prosecutor and the judge reviewed the evidence presented and concluded there is probable cause to hold your friend liable.

what he can do is to file a motion for bail so that the prosecution has to present its evidence. if it turns out that it is not strong, then bail will be granted.

to me, none except purpose and format. they are just both documents allowing the affiants to present their evidence. is there really a warrant of arrest? a counter affidavit would no longer be relevant if there is one already.

Tama po ba ang pagkakaintindi ko:?

POSITION PAPER - lahat COMPLAINTS ko at lahat nang gusto kong sabihin na papabor sa akin pati yong mga questions ko sa kalaban.

COUNTER AFFIDAVIT - pagsagot mo sa mga inaakusa ng kalaan sa iyo o pinapabulaanan mo ang akusa sa iyo ng kalaban.

while not technically accurate, your interpretation is substantially correct. a counter affidavit is more proper in a criminal case. a position paper is used in proceedings mostly in quasi-judicial bodies such as the nlrc. these are just titles.

fiscal issues resolution and forwards information to court. judge reviews record then issues warrant of arrest

actual dismissal is the company openly terminating an employee. constructive dismissal means the company intentionaly made the working environment so unbearable that the employee left or resigned.
