Sir,may problem po ako about sa land ng father ko na pamana sa kanilang magkakapatid ng parents nila nuong nabubuhay pa ang mga ito, dipa pa ito nahahati sa kanila pero alam na nila kung saan at alin ang sa kanila. Matagal nang nasa maynila si papa at dito na kami lumaki, bihira lang syang bumisita duon. Nakatirik po sa isa nyang lupa ang bahay ng mga pamangkin nya pero may usapan namn sila na aalis kung gusto nang tirikan ito ng bahay ng father ko. Yung isa namn ay sa bundok kung saan tinatamnan ito ng anak din ng kapatid nya (pamangkin). Sila rin po nakikinabang sa ani duon. kung meron man, konting padala lang pagdumadalaw ang father ko sa kanila.Minsan pag-gipit nakakautang po siya sa pamangkin nyang nag-aalaga ng lupa nya sa bundok na tinatamnan din nila.
Kailangang po bang father ko din ang magnayad ng buwis sa mga lupang iyon kasi nga ang pagkakaalam ko po e di pa talaga nagagawan ng titulo, buo pa po, hawak daw po ito ng isa nyang pinagkakatiwalang kapatid, gusto ko nga pong pagawan ng titulo kung kinakailangan habang buhay pa po ang father ko, kasi yumao na rin po yung kapatid nya na yung bahay ng anak nya ang nakatirik sa lupa ng father ko at sa bundok. May habul din po ba father ko kung balak nya na pong bawiin ang mga lupa na alm nyang sa kanya. Tiwala po kasi sya sa verbal contract ang mga ninuno namin. Ano po ba ang steps by step na dapat namin gawain? kasama na po ang tungkol sa buwis na ang nagtatanim at nakikinabang ay hindi ang father ko.Yun lang po kasi ang natitirang pagaari ng father ko na alam kong mahalaga din sa kanya. please advise me.

so the title is still in the name of the parents? your father can still claim his inheritance which he owns by his own right. given the time that has passed, there will be hefty penalties and taxes to be paid to the bir, but nevertheless your father is entitled to his rightful share.

As I've heard, its a document which only says where it is located and the measurements of the said land but even my father don't even know if there is really a "title". Is there really a possibility that they can divide their inheritance without the "title"? and if there's no title, how can my father run after his share? and if it is proven that that "title" exist but still as a "whole title" and still not divided to them, who has the responsibility to pay the taxes?. I advise my father to make a title for his share, it is possible to make one? and what should be the documents needed? I advise my father to settle this because it will be more complicated if their left children will handled this in case they passes away.

in that case, you will have to do research first. what is this document you mentioned. whether there is indeed a title or a tax declaration. if no title, whether there is an application with the denr to have it titled
