Atty. Good Day!
Nagresign po ako sa company ko last August 12, 2014. 30 days po yung notice. Nung nagkausap na kami ng HR, sabi nya 2 months yung leadtime. I checked my contract, ATLEAST 2months nakalagay dun. Can I pursue with the 30days notice as what was on the labor code? Need ko po advice niyo.Then, can I still have my 13th month pay? Thanks.

30 days only if pumayag sila.

The labor code says:

"An employee may terminate without just cause the employee-employer relationship by serving a written notice on the employer at least one (1) month in advance."

So minimum is 1 month, pwede mas matagal based on the contract.

Hello. Goodmorning. Gusto ko lang po itanong kung my pwede akong gawina bout my situation.
nahire ako sa company(call center) na to nung june 23,2014. im still on training. last august 30, ang sinahod ko lang ay 1800. tapos lumabas na absent ako ng 9 days. which is no tue dahil wala naman akong absent. so sinbi ko sa trainer ko,tapos sorry daw,nagkaproblema lang daw. so i feel so bad receiving just 1800.
so nung sept. 1, nagsubmit ako ng resignation.
ang gusto nila magrender ako ng 30days.
pinirmahan ng hr ung resignation ko nung september 4. ang nilgay nila,"received. requesting for early exit but up to the aproval of management" tapos sabi sakin sasabihan nalang daw ako kung papasok pa ako sa monday. tapos kahapon sabi sakin, kailngan ko daw magrender ng 30 days kung hindi magbabayad ako ng 75k dahil un da wung nakalagay sa kontrata na pinirmahan ko.
panggabi po tlga ang shift ko. 8pm to 5am. tapos sabi sakin kahapon, sa monday daw papasok ako ng 8am to 5pm at magtatype nalang daw ako ng mga dapat kong itype. which is hindi ko maintindhan. paano magrerender ang isang taong nagreresign from training?
tapos iniba nila ang shift ko,at hindi ko na kasama ang mga katrainee ko para gumawa ng something na hindi naman covered ng job descrption ko dahil im supposed to be ON TRAINING.
honestly,ayoko na po sanang magrender since im on training palang naman.

1. Nagkaproblema daw so dapat ayusin. Dapat sana hintayin mo din na maayos ang problema. Resignation does not solve anything. Lalo na kung wala ka namang lilipatan agad.

2. Technically (and legally) you are required to render 30 days.

3. Management has the right to assign you to a different schedule. If you are unsure or something is not clear, then you should ask.

4. In theory dapat nga hindi na mag render ng 30 days kasi sayang lang ang ituturo sa iyo. Pero hindi bawal na ipag-stay ka at hindi agad tanggapin ang resignation mo.

Gud am po ask ko lang... Gusto ko na po kasi magresign sa company nmin kasi pinapagawa nila ako ng mga bagay na ndi approve ng doh so illegal po at pinapagawa ng trabaho na hindi ko naman tlaga trabaho. Pag nagresign po b dahil sa mga dahilan na yun at di tapusin yun 30days makakasuhan po ba nila ako at pagbabayarin ng 20k kasi yun ang nkalagay sa contract? Thank you po sa magiging advice
