I was employed for more than 2years one of the country's top nightlife brands. I had to wait for 2 years for regularization. Anyway, I resigned May this year and now I have an offer from an up and coming casino/hotel/entertainment company. My only concern is that in my previous employment, we were asked to sign a NON-COMPETE CLAUSE. I understand that the NCC is typically included in the contract (that there is just a separate section or paragraph that says "non-compete clause"). But for the NCC that my previous employer had us sign was a separate sheet, and it was in a form of a MEMO. All of us were asked to sign it, and saying no was not an option.
Now, I have the following questions:
1. Is a separate non-compete clause/agreement legal?
2. Is the 5yr period stated in the NCC reasonable?
3. If my previous employer's nature of business was a night club/bar and my potential employer's nature of business is hotel/casino/entertainment, would there be a conflict with regards to the NCC?
4. If I held a different position in my previous employment (receptionist) and I get hired as a floor manager in this casino/hotel/entertainment complex, would there be a conflict with regards to the NCC?
