good day atty. ask ko lng po if kahit po maliit nlng ang balance ko sa salary loan ko, mgfi2le p rin po b sila ng case o nananakot lng po sila? balance ko before ako ngstop ng payment due to unemployment ay 22000 but ngayon its 37000 na po. my nakausap ako s legal dept ng bank pero ayw nmn nila ako bgyan ng magaan n terms of payment kaya ndi ko rin po nbayaran. tpos ngyon po my narecve ako n letter from isang law firm n i she2rift nila ang properties ko

37,000 is not small. it's up to the creditor whether they will actually file a case.

good pm po atty! Last january 09,2012 kumuha po ako nbi pero hit lumabas balik daw po ako ng 23 to get the result but im afraid. My story po kasi i have existing loan in 3banks feeling ko eto reason of hit. Since o resigned august 2010 nabounce n po mga checks ko . I thought i can get job in singapore unfortunately not kya back to zero ako dito last year and contractual but cant manage to pay my loan kSi plan ko to pay if mkapagabroad ako which is sna this year kya ako kumukuha ng nbi. npressured kasi me sa mga threath nila kya i changed my number at lumipat ndin s new house.mga demand letter narereceived ko noon but i ignored them in a while. my question are: pagbalik ko po b sa galleria s 23 bka hulihin ako dun possible po b un? my warrant of arrest ba ako at makukulong? estafa po b twag dito? nkahold na po b ako s immigration kung sakaling magtourist ako? Please help me po atty your answer could help me what to do thanks a lot

I would like to seek some help regarding my Salary Loan from a lending company. It was year 2010 of April when I borrowed php25,000 however due to an emergency, I have to resign my company where I previously worked. With this, I was not able to give a single penny to the Lending Company as I have to leave the company a week after i got what I borrowed.
Though I never got the full Php25k since interest and other fees has been deducted from it i informed them that I won't be able to pay for it since I no longer have a job but will start paying if I'll find one and get back to work, and as well pay (if possible) just what I owe them. They told me to talk to their manager and arrange everything through him.
It was year 2011 of November when I went back in contact with them when I first started my Job for me to start paying my debt. They said since it's almost a year it already reached Php75,000, I asked them if they can lower it down as I can't pay for that huge amount of money. They reached to me paying 45k (5k a month plus 1250 interest) I already finished paying them at least 20k in total last Jan. 2012 but I can no longer pay them more than that due to my expenses, was just able to pay them that amount that fast since I gave them my Xmas bonus and ITR just to cover my debts. I told them that I would like to close down the deal already and I will pay 10k to sum it up to 30k as I only borrowed 25k (did not get that full amount.
They insisted that they will allow me to close down the deal if I will pay 20k more before the month ends this March, I told them that I can only provide 10k as that's the only savings that I have. I want to push through paying and closing down the deal, but would it be possible for to just pay what I can pay (10k)they also said that if I won't be able to pay the 20k, they will still accept the 10k but will proceed with filing a case against me.
What actions can I do for this matter?

don't give them the 10k. if you didn't change residential or office address without informing them then no criminal charge will prosper

Hi po Attorney!

need advice lang po regarding a loan I've made last year. Nagloan po kase ako sa bank, worth 60k. I've moved out from our home pero nagpapadala ako ng pera sa brother ko to pay them, sadly hindi pala niya binabayad. Nagulat na lang ako at nakatangap ako ng sulat from the bank na hindi ako nagbabayad for 5 months and na endorse na nila sa collection agency ung case ko.

sa ATM lang naman po ung method of payment, hindi PDC. Makukulong po ba ako or makakasuhan nila ako? wala po kase akong ready na pera para magbayad agad ng full sum. ang kaya ko lang ibayad ay ung montly lang sa loan at next month pa.

Ask ko lang po kung estafa na ba yung nag-issue ako ng PDC sa isang lending company for a salary loan but I failed to make the first payment pa lang kasi nawalan ako ng money. Kasi ang pagkakainintindi ko po sa BP22 may intention ka magpay, meaning nakapagbayad ka na dati. Sa estafa, walang intention magbayad. I did let the lending company about sa nangyari and asked for an arrangement pano ko makakabayad but they harrassed me verbally. thanks po.

I need your advise po regarding my concern. Last year po kasi nag loan ako sa isang tao na nagpapaloan. Bale ang collateral po dun eh yung ATM ko sa work. PAgka loan mo ibibigay sknya ang ATM at every sahod sya ang magwi-withdraw ng sahod ko at ikakaltas na ang hulog sa loan at saka ibibigay sakin ang tira sa sahod ko. ang problema nga lang po nagresign na ako sa trabaho ko at hindi ko na po nabayaran ang utang ko sknya. Natatakot po ako na baka makasuhan ako o baka hindi ako makakuha ng NBI clearance ko kasi sabi po nya sakin dati kapitbahay nila ang isang GEneral ng police/nbi at pwede daw nya ako pakasuhan. Nag aalala po ako na baka hindi ako makakuha ng NBI o magka HIT ako dahil dun. Please tulungan nyo po ako sa aking concern. maraming salamat po.

Hi atty. I need a legal advice regarding my problem. I had a salary loan last August 2011 from a cooperative bank in cagayan de oro. I loaned 45,000 but I only get 41,000 because they deducted for some of the service fee. I paid and sometimes the payment will be delayed due to some problems. I worked in a BPO industry and I paid monthly. from I guess April until August I haven't paid them because last April of 2012 I sopped from my work. Then I was told that if I can't pay for it they will file a case against me. I told them that I will pay them because I will be back for work. Now, my mother paid 2000 for september and 2000 for Oct. Now they are texting me that I will be paying 21000 all in all for those m,onths that I did not pay. I already talked to the manager that I will be paying for it every month. My due is on Aug. 2013. What should I do they are texting me again to pay for it or else they will file a case. Please help me.
