tanong q ln po...
my nacquire po kmi n property kaso wala p x titulo,deed of sale ln po un katunayan n sa amin n un lupa.

finollowup q po un npagbilhan nmin tungkol s title kso wala p x sagot.

s lolo pa po ng buyer nmin nkapangalan un lupa.

does the deed guarantees us that we are the legal owners of the property?

my assuarance po kaya un..

Ano daw pong reason why wala pang updates ? Why don't you transfer the title on your own ? Deed is just 1 of the proof but it can't guarantee full ownership without title and tax dec

Tanong ko lang, sino ang nakapirma sa Deed of Sale? Kung iba ang pumirma sa nakapangalan sa titulo, medyo may problema yata.

Para kay Den Daniel...Ung heirs ba ng lolo ng seller ang pumirma sa deed of sale? Kami kasi heirs din ng mga magulang namin at nagkaroon ng deed of sale between us heirs and the buyer at notarized. Hindi nagmaterialize o valid ung deed of sale ng magbabayad kami ng capital gains tax sa bir kasi ung titulo ay hindi sa aming heirs nakapangalan kundi sa mga magulang namin. To make the story short, eto mga documents na kinailangan: extra judicial settlement of estate with sale executed between us heirs muna at binayaran pa muna namin estate tax to obtain the CAR o certification authorizing registration; transfer tax from parents to heirs; publication of the extrajudicial settlement of estate with sale in a newspaper for 3 consecutive weeks; updated payment of the realty property tax o amilyar. Tapos ng lahat ng ito (estate tax, transfer tax, realty property tax, publication) at saka lang namin ginawa ang deed of absolute sale between us heirs and the buyer kung saan nagbayad kami ng capital gains tax at ung buyer documentary stamp tax at hati kami ng buyer sa notary public na gumawa ng deed of absolute sale. Ibinigay lang namin sa buyer, duplicate owner's copy ng title in name of our parents, certification of realty tax payment, copy of Original Receipt of transfer tax payment, certification of the newspaper publication, and the CAR. Yong iba pang gastusin na kinailangan ng buyer para mailipat sa pangalan niya ay sa kanya na.

Tanong ko lang, sabi mo deed of sale lang ang katibayan ninyo. Nagbayad ba kayo ng capital gains tax sa bir? Kasi ung deed of sale ay kailangan within 60 days after notorized ay babayaran ung capital gains tax, documentary stamp tax; otherwise may penalty na.

We have the same issue po ang kaibahan lng di pa kmi ngbigay downpayment ung seller kc ganyan din ang suggestion nya sa akin Punta kmi sa office ng DAR bigyan ako ng copy ng deed of sale I declare daw na fully paid na even na half payment lng ibigay sa Amin, installment ang terms of payment kc ung titulo nya is still under her grandfathers name,pero ang gusto ko kc thru lawyer na lng kmi mgbayran and notarized pero un ang suggestion nya, pls nid your advise kung Ano Mas mganda proseso. Ayoko rin po kasi mgka problema in d future Tnx.
