Actually po di ko masyado nabasa yung contract pero as far as I can remember nkalagay dun if ng breach of contract ako I have to pay 100,000. What circumstances pi ba ang pwedeng i consider as breach of contract?

hi atty good day po i realy need your advice ako po ay ang head ng family namin dhl yumao n ang aking ama. Ngtatrabaho po ako s isang contractor ng pldt. Nung mga unang bwan po ay sumasahod aq ng maayos ,pero habang tmatagal ay pliit ng pliit ito,frm 4 to 5k nging 2k at nging 500 nlng, maiintindhan ko po ito kung may absences aq eh . Tapos s work ko may designated partners kmi at ako nga po ang headcrew samin ng partner ko, ngtataka po ako dahil xa sumahod ng almost 3k ako 500 lng eh dpat pareho kami dahl partner q xa at pareho kami ng production, inilapit ko po ito s opisina at knuha nla ang payslip ko dahl mali daw ito at ng maitama,nkkpgtaka bkt nila kukunin ang payslip ko gayun tg1 kmi ng kopya lumipas ang ilang cut off ganun p dn ang ngyari at wlang feedbck gling s kanila.dmating po ko s point na ngaabsent ako dahl kht pumasok ako ay wla dn ako knkita s kbila ng pgcckap at pgbblad ko sa arawan, recently nga po ay nanganak ang kapatid ko at kelangan ko lumibn s trbho dahl wlang ttngin s anak ng kptid ko n isang taon p lng ang asawa niya kasi ay nasa probinsya nkdistino, s kbila ng pgpfollow up q s dpat ay itinamang sahod q ay pngwwlng bhla nila ito. Naicpan ko nga po mgresign at ipinasa ko ang resignatin letter q ng dec3. D dw ito tnanggap dahl nkkainsulto dw ang isinulat ko at nais nlang bguhn q ito at mgpkumbaba ako, sbi pti ay sagutin kn daw muna po ang sulat n ippadala nlang sulat.after ng ilang araw nktanggap nga po ako ng sulat na humihngi ng xplanation kung bkt d aq dpat iawol, dated ung letter nila ng dec3 but i recieved it later it was dec 8 q ntanggap. Sumgot aq s sulat nila at cnbi ko kung bkt ako lumiban, at nlgay q dn s sulat y aq ngresgn dhl i felt that i was not properly comp , that despite of the follow up there was no action taken, pnasa ko ito s knila at tulad ng resignation letter q ay gusto nilang bguhn ko ito.

Ang tanung ko tama po bng ipabago nila ito s akin? Na alisin ko ang dhlan kung bkit ako mgreresign dhl head ako ng pamilya,at kailangan ko cla suportahan and nghhnap ako ng greener pastuer who would compensate me properly,fortunately an opportunhty came and open its door for me.

At tma dn po bng wla akong 13th month not until a new resignation letter and response to their letter will be submitted

tama dn po b n after aq mgimmediate res ska lng nla ako ppdalham ng letter to explain kung bkt d ako dapat iawol?


Ps after nga pla ng isang week after q sumagot s letter that they want me to change ay nktanggap ako ng termination letter.

Hi Atty.,

I have sent my resignation letter last Dec 17 effectivity after 30 days in my current company. But I have a contract stating that resignation should be 60 days notice. I could not render the 60 days because I'll be starting on a new company after the 30 day notice. On the other hand, the contract that I have is a letter of appointment during my probationary period. Its my 9th month on the job and no formal regularization yet. Would there be any conflicts on my 30-day notice? Thank you.

Contract says 60 days and you agreed to it so you should follow it.

No issue in letter of appointment, you are regular automatically after the 6 month period.

They can ask any question, and do what they think is necessary, even to call the future company.

Ewan ko lang kung paano nila malalaman iyon kung di mo naman sasabihin kung saan ka lilipat.

Thank you atty. Ano po kaya ang pwede pong gawin if ever na mag complain po ang employer? Ang problem po kasi, hindi po updated ang dinedeposit na fund for BIR payments although kumpleto po ang bayad sa BIR monthly. May kabangga naman po na mga cash vouchers yung taxes fund, hindi lang po nare-replenish agad agad dahil gipit din po ang kumpanya.

Hi atty, sorry po for the late reply.. Yung mga taxes na binabawas sa mga suppliers, hindi po agad naidedeposit sa bank. Pero updated po yung pagbayad sa BIR monthly para hindi po magka-penalty. Bale po yung parang pinaka pondo dapat pang bayad ng bir is insuffucient dahil di po updated ang pag deposit.
