humihingi po sana ako ng tulong o payo tungkol sa aking asawa na kung ano ang dapat kong gawin at ano ang karapatan ko at ng aking mga anak dahil sa pagtalikod nya sa kanyang mga obligayon pra sa amin ng 2 anak ko at ano po ang pinakamabisa na pde ko ikaso sknya?,ganito po ang pangyayari sa buhay namin taong 1996 nakaalis po ang aking asawa pra magtrabaho sa bansang japan pro po TNT po sya doonskadahilanang wla po syang trabaho d2 me mga kapatid din po sya na 2 babae doon na ngtratrabaho sa japan nkaka3 months plang po sya sa japan napasimulan ko na pong ipagawa ang aming bahay unti unti pro po ng mag iisang taon po sya sa japan unti unting ngbabago madalang na po sya tumawag at sinabi niya sa akin na ihinto muna ang pagpapagawa ng bahay iipunin muna daw nya ang pampagawa hanggang sa nahinto po ang pagpapagawa ng aming bahay at marami nrin pong nabago sa mga dati nia ginagawa tulad ng pagtawag madalas na pong hindi na sya natawag sa amin ng mga anak niahangang sa me tumatawag na babae sa akin na hindi nagpapakilala kung sino sya babae po sya at ang sinasabi nya po sa akin ay niloloko raw po aq ng asawa ko dahil meron na itong kinakasama sa japan at katunayan daw po me anak na daw po sa babae at Gina daw po ang pangalan ng babae tinatanong ko po yung tumatawag kung sino naman sya bigla nalamang po binababa ang telepono at tatawag na naman s ibang araw hangang sa pati padala sa amin ng asawa ko ay kulang na kulang na at merong mga months na wla syang padala sa amin kung ano ano dinadahilan kesyo wlang trabaho byenan ko po ang ngsasabi skin pinasasabi raw pokung magpadala nman hindi na tulad ng dati hangang sa nagkakautang utang ako sa dahilang sa private nga aaral ang 2 kong anak simula kinder hanggang highschool.hanggang sa dumating din ang time na sa byenan ko na pinadadala ang pra sa amin pra isahan nalang daw po ang bayad sa door to door inaabot nalang sa akin ng byenan ko ang para sa amin na halos kulang umabot sa isang lapad ang pinaka tunay na asawa ng aking asawa kinausap ko po sya ng mahinahon para lang umamin sya na sya ang babae na aking asawa at tinanong ko rn po kung me anak na sila umamin din po na 2 years na ang anak nla ng asawa koang pamilya ng asawa ko ay alam din nila ang ginagawa ng asawa ko kaya ganun nalang pagtatakip nla at nahahlata ko na prang iba na ang turing nla sa akinprang unti unti nila akong tinatabla kya ganun po ang aking ginawa tumigil ako sa trabaho at umasa sa kanya hanggang sa dumating na pinasuko nya yung babae nya [pra madeport kasi TNT rin po yung babae pati anak nila na deport at buntis babae niya ng madeport po ang babae at anak nila sinundo pa po ng mga kapatid nya at byenan ko ang babae sa airport pati anak niya ng palihim ngunit nalaman ko rin kasi malapit lang sa akin ang bahay ng byenan ko tapos po nangupahan sila sa isang subdivision na malapit lang dito sa lugar namin na kasama sa bahay ang byenan ko ginawa nila lahat sa akin yun kasi patunay nila sa babae na papanindigan ang anak sa knya at napapayag ng asawa ko na sumuko pra umuwi dto sa pinas ang babae kasma ang anak nla sa dahilang natatakot narin ang asawa ko na baka mahuli din sya kapag magkakasama prin sila doonpro hindi nakatagalan ang byenan ko at ang babae na magkasama sa isang bahay umuwi ang babae sa manila sa pamilya nya ksama ang mga anak nila hangang sa sinusustentuhan nalang din niya 2 din ang anak niya doon hindi na kasi nakabalik ang babae sa japan hangang sa ngdecide na mag asawa ng haponesa ang aking asawa hindi ko alam kong paano sila kinasal o nakasal doon sinabi sa akin ng asawa ko na pra mag karoon sya ng papel pra din daw sa amin ng mga anak nya ung gagawin niya kapag me papel na sya sa pamaagitan ng haponesa pra malaya syang makapagtrabaho sa japan at madadala din daw nya mga Anyways po, hindi ko na tinapos dahil mukang kagaya din ng ibang case ang kakamantungan. Bilang legal wife po, nasa iyo ang lahat ng karapatan sa asawa. May karapatan kayo ng mga anak from moral support, love and caring and financial support from your husband. ngayon po try to decide kung ano po ang gusto mo mangyari sa asawa mo? gusto mo ba siyang makulong or gusto mo gapanan nya ang tungkulin nya suportahan kayo ng anak mo.

Kung hahabulin mo po ang kaso ng conccubinage or bigamy, kailangan mo po ng matibay na ebidensya and since limited ang resources mo at nasa ibang bansa sila. IMO, mahirap mapatunayan. Ang maipapayo ate ay sampahan mo ng kaso RA9262. psychological, emotional and financials abuse. mas maganda yung kasi mas mahaba ang kulong kumpanara sa concubinage.

Subukan mo ate na lumapit sa POA baka maka-kuha ka ng libreng legal service. May mga law colleges din na nabibigay ng libreng legal service. tyagaan nga lang at pakiusapan kasi mga busy din ang mga tao dun.

You forgotten to ask if the husband still goes back to the Philippines since he already have documentation in Japan which only means he managed somehow to become Japanese citizen.

Article 7
The Minister of Justice may permit the naturalization of an alien who is the spouse of a Japanese national notwithstanding that the said alien does not fulfill the conditions set forth in items (1) and (2) of paragraph 1 of Article 5, if the said alien has had a domicile or residence in Japan for three consecutive years or more and is presently domiciled in Japan. The same rule shall apply in the case where an alien who is the spouse of a Japanese national has been married with the Japanese national for three years or more and has had a domicile in Japan for one consecutive year or more.

Somebody has to dig in his record from the Japanese side that his marriage is null and void with the Japanese woman because he is already married in the Philippines. He must have declared he is single at the time that's is the reason why he managed to marry the Japanese woman.
You will need a private investigator who can act on your behalf or do it yourself to chase after him in Japan. Because the falsification happens outside Philippines jurisdiction but will have a chance to get him under Japan's jurisdictions. This is the only way you can go about it! Otherwise suing him under Philippines jurisdiction has no standing.

Remember Gabby Concepcion's case? He is already married in America when he marries Sharon Cuneta and his first wife's driver reported his marriage in the Philippines and they arrested Gabby Concepcion when he went home because the second marriage which is bigamous happens in the Philippines. But in the end he was actually acquitted.

I agree, but as just like what i said; concubinage or bigamy is quite difficult to pursue because of some reason, that is why i recommended RA9262.

With the case of Rose and her hubby, nauna silang ikasal sa pinas bago pa ang kasal with the  Japanese girl. And if my memory serves me right, maaring invalid ang kasal ni lalaki sa Japanese girl because of the main requirement from the side of the Pinoy; the legal capacity to get married. (this is base on my experience. ilang Japanese at Pinay/Pinoy na din ang nilakad ko ang kasal). IMO, fake ang mga documents na ipinasa ni lalaki sa Japan kaya sila naikasal ni Girly Japanesa. In this case, i strongly see RA9262 as the most appropriate case. plus if possible, falsification of public documents.

I hope our lawyers here can share their opinions as well, in this particular case.

That's if the husband still goes back the Philippines, then she might have a chance to file a case RA9262 but if he already obtained Japanese citizenship, She needs to chase after him in Japan because the bigamous marriage happen in Japan not in the Philippines. If he were married twice in the Philippines then he is in for bigamy case otherwise the bigamous happens in Japan and its under Japan jurisdictions.

As I've said, because of some complication, RA9262 is the most appropriate. And she can file it even if the husband is in Japan.

When is comes to bigamy, saying that the husband cannot be prosecuted because the bigamous marriage happened in Japan, well, that is the long belief. As far as i know even the Supreme court have not yet decided if that argument is correct.

IMO, considering the elements of the crime, being legally married in Philippines, that alone already made the husband liable for bigamy. if not because of that marriage, his marriage in Japan will be valid in Philippines. We should also consider the fact that the crime was committed when he is still a Filipino citizen.

The case of Gabby did not reached Supreme Court.

But you have to consider her situation she has NO MONEY, in order to chase after her arsehole husband she should have enough money to sue him! I doubt PAO will even spend time with her. And she should get hold of his marriage certificate from Japan to use as an evidence for bigamy. If you know the jurisdistion, Japan is outside Philippines jurisdication. This things are not easy to prove unless she go to Japan and sort it out herself, that's if she knows where he is exactly residing, otherwise she's like searching needle in the middle of the forest!
The second live-in partner who has been in Japan cannot go back neither because she is already black listed in Japanese immigration.
I work abroad pretty much been in many places and I know so many Filipino/Filipina who are married back home and also married where they are living! They don't go back to Philippines anymore for decade. The Philippine Embassy cannot help them unless they hire an investigator and send their lawyer to represent them outside Philippines. BUT ONLY RICH PEOPLE CAN DO THIS!!! Otherwise, she can keep her case open in the Philippines until he returns, that is if she has enough evidence to nail him then the case might prosper.

Also we cannot assume that his marriage to the Japanese woman is null and void, this is only under Philippines jurisdictions if he is married twice in the Philippines the second marrriage is regarded as NULL and VOID! We have different law to other country all together. It maybe null and void in the Philippines jurisdictions but not in another counrty's jurisdictions.

As i've said, again, my opinion is, because of some complication, she should proceed with RA9262 instead of concubinage and/or bigamy. I ‘am fully aware of the complexity of that kind of bigamous marriage – however my stands is firm.

RA9262 will only move forward if the accused is in the country, otherwise the case will remain pending because the accused is no where to find unless she knows his exact address in Japan so they can send the copy of the demand to him! Otherwise, how can she chase after him?

So true! even here in the US there are lots of foreigners who are married back in their country and not all of them can be sued for maintenance because they can't afford to, they cannot chase after them abroad and in the states they do not get involve in a case outside their jurisdiction not unless its about terrorism.
