Hi po...
Need po ng advice.
Yung HOA officers po namin ay walang ginawang election for this year 2014... Ang rason po nila sa aming mga home owners ay sinusunod lang daw nila ang nakasaad sa Magna Carta ng HLURB na pwede pong i-extend ang term nila without election.
Yung present chairman po kasi namin ay 2 consecutive years ng BOD ng aming HOA , 2 taon po syang sunod na nanalo sa election. Nung 2012 po, sya po ang inilagay as VP ng mga BOD at nung 2013 po ay sya na po ang Chairman. Ngayon pong October 2014 po sana ay dapat po ay magkakaron ng election pero di po isinagawa ng mga officers.
Naging Chairman lang po biglang wala na pong yearly election. Pag tinatanong ng mga homeowners ay sya pa ang galit at pabalang at laging ikinatwiran na pwede daw ang term extension without election sa HLURB Magna Carta. Pero po ang sa approved by-laws po ng aming HOA, nakasaad po dun na may yearly election. no term extension unless tumakbo uli at nanalo sa yearly election. Tama po ba ang Chairman namin at mga officers na walang magaganap na election? Tama po ba yung sinusunod nila na Magna Carta ng HLURB, nakasaad po ba yun sa Magna Carta yung sinasabi nilang term extension? Tama po ba na di nila sundin ang by-laws ng HOA namin?
Gabayan nyo po ako... pwede po ba kaming magreklamo? Kanino po dpat maghain magreklamo?

michie: Wag maniwala sa Chairman of the Board nyo na gusto ata ay chairman for life ng inyong association. Two (2) years lang ang maxium term of office ng members of the Board ayon sa RA9904 and there ought to be an election as provided in your association by laws.

P.S. In a similar case I handled for a plush subdivision homeowners in Alabang, I advise the whole board membership to dissolve the board as provided for in the by laws to pave the way for a new election for a new set of officers. My take is consult your by laws.
