Hi Sir / Mam,

Question lang po regarding labor laws in terms of undertime.

Ang scenario po kase ay down po ang computer systems and tools kaya hindi nakakapag trabaho ang ilang mga tao sa isang company. May mga ilang naayos naman ang system agad kaya naka pag work ng maayos pero may ilan namang hindi tlaga nagawa simula umpisa ng araw (Lets say 8-5 ang shift)

nag decide na lang po ang company na pauwiin na lang lahat ng mga hindi naka pag trabaho simula 8am ng 2pm dahil sa nagsabi na ang system admin na hindi na magagawa pa ito ngayong araw. Ito ay considered undertime. babayaran pa din sila from 8am to 2pm kahit wala silang nagawang trabaho at all.

Tama po ba ang company sa decision nila or pwedeng labag to sa batas at marereklamo ng mga tao na napauwi nila na hindi nabayaran ng buong araw?

Kase sir, ang katwiran ng mga tao, hindi naman daw nila kasalanan na masira ang system at hindi din nila gustong umuwi kaya daw dapat binayaran pa din sila ng buong araw?

in my opinion, if the employee is present and ready to work, he should be paid for the entire day. the recourse is to file a money claim at the dole office.

hndi kayang mag charge ng overhead ng company sa salary ng mga empleyado due to system failure. be thankful dahil atleast kahit pano nabayaran yung particular hours na nag stay kau sa company.

Hi ask lang po ako. 3 years plus nku sa company(call center ) and may times na pinapa overtime and meron naman times na undertime, all because of business needs. Okay lang that time because tag 2 months lang naman and then balik normal na.

But for the past 1 year, lagi nlng may memo na forced undertime na maximum of 15 hours a week. Di na kami sumwesweldo ng maayos dahil dito. We used to get 9 to 10 thousand but now we only get like 5 to 6 thousands per 15 days. Tapos mahirap pa eh hindi nlng straight shift binibigay sa amin. Like papasok kami ng 8am tapos papa logout from 10am to 2pm tapos work ulit. Hnd nlng ung half day tapos uwi after lunch. May nilalabag ba sa labor code ang employer ko?

Hi good day! May itatanong lang po ako. Meron po bang article under our Labor Code na nagsasabi kung ilang oras ang dapat na rest between shift or schedule ng isang empleyado?

walang nilalabag ang employer. This is called broken time and practiced mostly in the food industry but also adopted in certain degree in other industries. As long as binabayaran ka sa hours na pinasok mo, walang violation ang company.

Working in 2 different shifts po. kung my minimum time na kelangan ng employee to rest then start another 8 hour shift.
