Good day po atty.need ko po tlg ng tulong nyo ngayon sa sitwasyon ko.sana po matulungan nyo ako.
isa po akong single parent.may trabaho po ako ngayon at sa may pa po matatapos ang contract ko..wala po akong planong umalis sa trabaho ko kahit n kulang tlg ang sinasahod ko para sa aming 3(2 po ang anak ko)
Last dec.mag message po ang tita ko sakin n uuwi xa ng phil.galing korea.gusto nya po po ako dalhin sa korea para mgtrabaho dahil malaki daw po ang sahod.
kaya po nag desisyon ako n magresign sa trabaho ko ngayon.
last dec.16,2014 nagpaalam po ako sa visor ko n magresign ako effective this jan.16,2015 one month ahead.pumayag po naman xa.kso po nung nagpasa n po ako ng resignation letter ko sa office.ayaw po pirmahan ng pinaka may ari yung resignation ko.i have to finish my contract with them daw po.kahit n sinabi ko po dun na.kulang po tlg yung sinasahod ko s knla para sa 2 anak ko n nag aaral n.at sayang po yung tulong n inoofer ng tita ko.
sabi po nila sasampahan daw po nila ako ng kaso.
tanong ko po.pwede po b tlg nila ako sampahan ng kaso at hindi po b tlg ako pwede mg resign kahit n for the future of my kids ang reason ko.

pwede naman magresign basta magbigay ng tamang pasabi.

Pero ano ang nakalagay sa kontrata mo tungkol sa ganun?

Sigurado ka na bang makakaalis papuntang korea? Meron ka nang visa?

Kung wala pa, sayang naman ang trabaho lalo na kung hindi sigurado ang pagkakataon na makaalis ka.

Sigurado na po.nilagay ko naman po ng maayos sa kontrata ko na nagpapasalamat ako sa pagtanggap nila sakin.n sana po maintindihan din nila ang sitwasyon ko.na lumalaki ang mga bata lumalaki din po ang financial needs nila.at 1month ahead naman po ako nagpasa ng resination letter ko.
di ko po maxado nabasa yubg contract ang nabasa ko lang po dun magbabayad ako ng25,000 pag d natapos yung conttact po.
atty.sayang po tlg kc yung chance at oppurtunity.makakasuhan po b tlg ako.malapit n po kc yung jan.16 n effectivity ng resignation ko.

Halimbawa po atty.nakiusap naman po ako ng maganda,my one month ahead naman po ako nagpasa ng resignation ko po.pero di parin dila pumayag.pag n di n aki pumasok sa 16,yun po yung date n nakalagay sa resignation ko.pwede po b nila ako kasuhan,pag di na po ako pumasok sa 16.salamat po ng madami

Kahit n po nagbigay n ako ng 30days advance notice sa boss ko na magreresign po ako still pwede padin po ako kasuhan?
tsaka ask lang po.nalilito po kasi ako.ano po ba yung cover ng "resignation"Kasi po gusto po nila tapusin ko kontract ko.ehindi n po resign yun,end of contract n po yun.e gusto ko nga po mag resign.nalilito po ako.salamat po.godbless

moderator
in my opinion, term employment contracts can be terminated by employees with due notice. the employer has no choice or say if the employee gives 30 day notice.

Good day atty.! Nagresign ako ng nov. 11 kasi kelangan ko ng magstart sa new work ko ng nov. 17. So, hindi ako nakapag render ng 30 days. By the way, i'm with the conpany for 3 years na. When i filed my resignation letter, kinausap ako ng supervisor ko na possible mahold yung coe and back pay ko.

My question is, hanggang kelan po nila pwedeng ihold yung coe and back pay ko kasi hanggang ngayon hindi ko parin nakukuha and kelangan na sa bago kong company yung coe. And ano po yung mga benefits na makukuha ko? Kasama po ba ang 13month pay and conversion ng unused sl/vl? Sana po matulungan niyo ako. Thank you.

nakasaad sa batas (labor code) na pag hindi ka nag-comply sa 30-day notice, pwede kang sampahan ng kaso at humingi sila ng danyos (damages) laban sa iyo.

tungkol sa mga benefits, check the company policy.

Yun suspension po sa akin ng 10days without pay ng dahil lang sa pagsulat ko ng grievances sa hr. Di po ba napaka inhuman nyan. May mga anak ako na kelangan buhayin. 10days without income?

Hi po, I resigned last feb 3, 2014.

I work in a logistics company, but they employed us from the agency. It takes 4 mos. before I signed the contract from the agency stated there that my employment is until 5 mos. Then 5 mos later they dont have noticed me of my status. I am working for almost 2 years now in the agency without signing any contract. Their rules are No work No pay. So i decided to resigned to find better opportinity, stated in my resignation is only 15days from my notice period. Atty. do i have to leave my position within my noticed period or should i serve for 30 days? Then the company that i am working offered me that they will absurb or they will employ me as a direct employee in their company. Pls advise. thanks
