Hi,

what are the punishment for this case? my ex wife filed a case against me for RA9262. I admit i did hurt her by slpping her and holding her on the neck and texting her which she said is very emotional and psychologically torturous to her.

if i go to jail, how long?

i don't know if she had a medico legal. i have no lawyer yet and the initial hearing will be on nov. 10, 2010. i don't know what will happen or to look forward.

the subpeona was recieved by my cousin and i am not living there anymore. the first time this happened(the violence) was dec19,2009 then last was sept23, 2010. since then i tried my best not to contact her but just call my daughter. i also volunteered to teach kids to keep myself busy and refocused on what i have to do to be better

did the complaint come with the subpoena? you can ask for time to prepare your counter affidavit. i recommend that you go to the hearing. most prosecutors try to get parties in 9262 cases to reconcile

when i attended the hearing, that is the only time i saw the complaints and medico legal. it says that she had lessions where she claimed i punched her twice. if i did,which i did slap her, her cheek would not be just swollen. the medico legal also states she will only have to rest for 9 days.

she also claims that i forced her to have a cyber sex with me that i used my child to force her coz she claims that if she deny me i would change m,y attention to my daughter which i honestly would never do. i also noticed that there are a lot of her stories to be inconsistent with the barangay complaints and hearing proceedings where she said that her mom's friend is just a friend but in fact her mom's lesbian live in partner. and that when i poked a knife on her, she did not mention that her mom belittled and ridiculed me and she did nothing. that was the reason i was forced to do that, i was provoked.

the initial investigation or hearing, the prosecutor advised us to talk and settle it but my ex wife does not want to talk. i talked and humbly asked for us to settle it but she is firm. my psychiatrist told me that i reacted because the trigger of being provoked caused me to burst in anger like that, would that be a defense on such scenarios? would bringing the character of her mom and contributions of her mom to our fight be a good defense as well? since they are living in her mom's house and most likely her mom's lesbian "friends" go there still may be corrupting my daughter's mind though she claims that her mom's friend does not go there anymore. is it also ground to dismiss the case if i found evidence that she is doing this because she has a bf already and wants to use this to file for annulment and child custody?

your anger can explain why you did it, but this does not exempt you from criminal liability for doing so. you can mention the scenarios in the house, but to me, this is not the best possible defense. i recommend to you to acquire legal counsel to prepare your counter-affidavit. good luck.

tanong ko lang po kasi nagfile po ako ng case againts sa dati kong ka-live in. R.A 9262 po ang sabi sa akin.pinapunta po ako sa womens desk para magpagawa ng statement. wala naman pong physical abuse na nangyari pero more on emotional torture po ang nangyari sa akin.kasi po kahit na po kung ano anong sinasabi sa akin ng kapatid ng ka-live in ko,hindi man lang po sinasaway ng partner ko.kahit po sabihin ko sa kanya ang mga tsismis na gingawa ng kapatid nya,hindi nya po ako pinapakinggan.kahit po sinasabihan ako ng kapatid nya ng tanga,balewala lang po sa kanya.at kapag gusto ko po syang kausapin tungkol sa kapatid nya,tinutulugan lang po nya ako o kaya po ay nilalayasan ako.hindi po sya nakikinig sa akin. tuwing makikita po ako ng kaptid nya,nagpaparinig po sya.sisgawan po ako at minura ng kapatid nya pero wala po syang ginawa para protektahan ako.at sa tuwing makikiusap po ako sa kanya na dun muna ako sa amin,palapgi nya pong sinasabi sa akin na kapag umuwi daw po ako sa amin,dalhin ko na daw po lahat ng mga gamit ko at hindi na daw po sya magpapakita sa akin kahit na kelan.ang ina at kapatid na po nya ang nagdedesisyon sa buhay naming dalawa imbes na kami.sinusunod ko po sya palagi.halos umiiyak na nga po ako sa kanya sa pakikiusap na dun muna kami sa amin pero ayaw po nya.wala naman po syang masabing dahilan sa akin kung bakit ayaw nya sa amin.simula pa lang po,alam nya lahat ng ginagawa sa akin ng kapatid nya pero nagsasawalang kibo lang sya palagi.at nung minsang nagpunta kami sa bayan,nakita nya ang kapatid ng dati nyang niligawan bigla nyang binitawan ang kamay ko at iniwan ako para batiin ung babaeng nakita nya. at nung malayo na kami dun sa babae,saka lang nya ako hinawakan uli.at palagi po nyang sinasabi sa mga kabarkada nya na isasauli na daw nya ako sa amin.pwede ko po bang masabi na emotionally abused ako?

resguerra, don't focus on format. the purpose of a counter affidavit is to show how the complaint is wrong, and show evidence of what is right.

cezm, while i agree you are experiencing emotional distress, i have reservations whether this will qualify as the criminal act defined in ra 9262. at the minimum, i hope your boyfriend realizes how hurtful his acts are and straightens out.

sa ngayon po ay magkahiwalay na po kami pero ayaw na po nyang magsuporta sa magiging anak namin.sabi pa po ng magulang nya ay wala na lang daw pong pananagutan sa akin ang boyfriend ko.hindi na po sila nakikipag usap sa amin at pinamamalita pa po ng bf ko na ipipi DNA test daw po nila ang baby namin paglabas nito dahil nagkaron daw po ako ng bf bago ko sya naging bf. natanggal po ako sa trabaho ko dahil sa sobrang kahihiyan ko sa mga tao.pinag uusapan po ako ng mga tao sa lugar namin. pwede po ba akong humingi ng moral damages sa dati kong live-in partner?

cezm, you first have to prove that your live-in partner is the father before you can claim support. it will be good if he spends for the dna test.

in your previous post, you describe what you call emotional torture, but as I said, i don't think this will qualify as psychological violence because you say it was the kapatid who said abusive things.

how about po yung pag ababdona sa akin at sa ipinagbubuntis ko. am i not entitled for moral damages?dati po dun kami nakatira sa bahay nila. tapos po nag awawy away cla at ako nga po ang pinagbuntunan ng galit ng kapatid nya kaya po nagpaalam ako sa partner ko na uuwi muna ako sa amin but then sabi nya,sasama sya.dun na lang daw kami tumira sa amin so pinadala nya sa akin ang ilang gamit nya akin. pero hindi na po sya nagpakita sa akin after that. ilang beses po syang ipinatawag ng ama ko para makausap pero hindi po sya talaga nagpakita.tinatawagan ko po sya at tinetext nun pero never po syang sumagot.hindi na daw po sya papuntahin ng ina at kapatid nya sa amin.and he was claiming na hindi na daw po nya kayang makisama sa akin dahil daw po sa ginawa ko sa magulang nya samantalang wala naman po akong ginawa sa kanila.ako pa nga po itong minura din ng kanyang ama.lahat po ng sabihin nya at ng pamilya nya,sinusunod ko.kung ano po and desisyon ng ina nya,un po ang nasusunod.ginagawa ko po lahat ng sabihin nila.kahit na po puyat at pagod ako sa trabaho ko,pinipilit ko pa rin pong gawin ang obligasyon ko sa partner ko.ultimong pambili ng sigarilyo nya,ako ang nagbibigay.nagkasakit po ako dun pero ni minsan,hindi man lang po ako naintindi ng partner ko.kelangan ko pa pong tumawag sa mom ko.sobrang sama na po ng loob ko pero wala po akong magawa eh.mahal ko po sya at gusto ko nga pong maging maayos ang pagsasama namin hanngang sa maikasal sana kami next year kaya po tiniis ko lahat ng yun.ano po ba ang dapat kong gawin?

against the sister, unjust vexation, but it should be at the bgy first if you live in the same city or municipality. else in the prosecutor's office, but should be within 2 months from the time of the incident.

yes, you can also consider a civil case for damages against your live in partner. good luck.

I want to ask. ME and my wife got a big quarrel actually almost every night we had a fight. But last week I got her slap in her face. On her attempt to escape she was hit by the post. Then she went to the hospital and got medical certificate and make a blotter. She filed a against on this VAWC. And I voluntary surrender from the police. She filed the case and my family tried to convinced her not to pursue the case. After almost 8 hours convincing her while we are in the police precinct. So she withdraw the affidavit about the case and we made agreements. It all includes that if she said that I must not go to work I must not go. And also she demand me not to go work for Sunday which is the nature of our work that has Sunday duty but if she said not I should not. I sign that agreement to settle things not consulting the company I work if it is okay to be like that. She also confiscate my cellphone. By the way we have been married for 3 years and no child, we just adopted her son on her first boyfriend whose 6 years old now and treat his as a real son. And also part of the agreement if I got mistakes again or if I will not follow what we agreed she will file again the case RA 9262.
My question is are all agreement are valid?
If I have plan to file annulment since I can feel that we don’t trust each other anymore can I still file? I m scared that if we talk things like this she will file the case again.
Or what shall I do? Im confuse.

the agreement cannot be a legal defense in a case of ra 9262. even if you fulfill all the conditions and she still goes on the case, you cannot cite your agreement to defend yourself because vawc cases cannot be compromised.

that said, it doesn't mean that both of you can abide with the agreement. as for this sunday issue, you can request your employer but they cannot be forced to fix your schedule.

nagfile po ako ng case againts my former live in partner.VAWC po..nag issue na po ng subpoena sa kanya.pinatatawag po kami sa fiscals office sa dec.15..tanong ko lang po what will happen kung hindi po kami magkasundo?ang gusto po kasi nila at ng pamilya nya eh wala ng pananagutan sa akin at sa bata ang former partner ko..pwede po ba yun?.nalaman ko din po na nag apply po sya papuntang ibang bansa at ang pamilya pa po nya ang nagmamadaling mapaalis sya ng bansa.ano po ang pwede kong gawin.baka po kasi makaalis sya ng walang settlement na mangyari eh.

if there is no agreement, then the case will continue. he will be asked to file his counter affidavit. if it is proven that he is the father, then he has a responsibility to provide support.

yes, you have to be the one responsible for filing the application.
