I just want to ask about a certain dilemma.

An extrajudicial settlement of estate was created between siblings. Knowing that one of them is adopted, they gave a portion to that sibling anyway.

Everything was already transferred to respective names.
After a year, they found out that the adopted one, didn't undergo the process of legal adoption.

Being aware again, the other siblings did nothing, and for them the ESE is still enforced and it didn't matter because they've always treated that one as real sibling.

Questions, dear fellows:
1. Is the ESE valid?
2. Will there be any consequences in the future?

Hi,

Yes, kung wala naman magcocontest doon sa ESE, presumed VALID yun. At kung mahal ninyo yung ampon ninyong kapatid at tunay na kapatid trato ninyo sa kanya, wala namang problema. Kaysa naman kawawa siya kasi wala man lang siyang share (out of the goodness of the hearts of the true children).

Wala naman consequnce in the future, lumiit lang yung share ng true children. Pero as I said earlier, kung to too naming kapatid trato doon sa inampon at wala kokontra, wala namang problem.

Share ko lang isang experience...baka makapulot ka ng idea. Ang ate ko may nagiwan ng isang sanggol sa kanya na ipinahawak lang upang umihi ung ina, tapos di na binalikan ang ate ko. Kaya pinablotter sa pulis at lumaki iyong bata walang naghabol maging sa pagtatanong sa pulis wala rin. Dahil hindi alam ang pangalan ng bata, pinaregister sa civil registrar's office sa pangalan nilang mag-asawa na sila ang mga magulang. Ngayon ay may asawa na iyong bata at may 4 ng anak, at saka napagalaman kung sino ung tatay. Ung nanay pala niya naanakan ng tatay kaya ginawa ng nanay ang pag-abandon. Nung namatay si ate, kasama siya sa 4 na tunay na anak nina ate sa pagbibigay ng mana kapantay ng 4 na tunay na anak. Tinanggap ng 4 ang decision ko dahil bilang administrator ng property ng mga magulang namin at ung mana ni ate ay hindi ko ibibigay sa kanilang 4 at magpetition muna sila sa court na alisin siyang karapatan bilang adopted sibling. Kaya pumayag na rin silang ituring na tunay na kapatid at pinaghati ko silang 5 sa mana ng ate ko sa mga magulang namin.

Just a follow up question.

How about if one of the siblings contest the extrajudicial settlement in the future?
Like the one posted here, when an heir changed his mind.
Can it be a ground for the annulment of the document, just because the other party is not supposed to be one of the heirs?

Can it be argued that the parties involved already knew about the doubt, contingency or risk affecting the object of the extrajudicial settlement and still they signed?

Ask ko na rin, kapag ba nawalan ng mana ung ampon, ung buong extrajudicial ba ang mawawalan ng bisa? Or ung portion lang ng share nung ampon?

For Quiryalot: Kung may magcocontest sa EJS ay mahabang proceso, ie., proving ampon nga siya. May birth certificate ba siya sa pangalan ng mga magulang ninyo? Isa pa what you have agreed upon among you, the court cannot reverse it, kasi personal ninyong kasunduan iyon (Rule 73 and 74 of Rules of Court). I think when you considered and treated that one sibling as true blood and flesh ninyo is enough evidence that what you have done is in good faith. The EJS I think will remain valid until proven in court that what was done was not in good faith, otherwise the inheritance could have not been registered in your individual names. Well, good luck!
