Employer to forfeit last salary of the employee

Good Evening,

is it right for my employer to forfeit my last salary because i got terminated from work because i ignore my manager final warning not to be absent again without informing or not having a valid reason why i didn't turn up for work for 3 days from January 23, 2015 - January 26,2015 and i texted my manager that im going back to work but he suspend me until further notice. Because i found a new job when i was absent for 4days but i didn't tell my manager that was my 2nd warning and when i came back to work on January 6, i handed my resignation but its only 17 days notice my last day i put on the letter was January 23, 2015. But my manager didn't approve it. so when i got suspended and eventually got terminated it works with my favor because i start working last week February 2, 2015 with my new job. can i still get my last salary? what can DOLE do to help me?

Hindi ka nag comply sa 30-day notice so pwede kang idemanda at hingan ng danyos ng kumpanya kung gusto nila.

Para malaman mo kung meron kang makukuha, magpa-clearance ka.

ang sabi ko kasi sa employer ko kung hindi ako pwede umalis sa January 23, 2015 sa January 31, 2015 na lang pero hindi pa rin 30 days notice pero pwede sana ako mag extend hanggang February 6 para maging 30 days notice pero kasi nung January 22, 2015 day off ko pero January 23, 2015 hanggang January 26, 2015 hindi ako pumasok and suspend nila ako kaya hindi ko na ma-i-extend para umabot ako sa 30 days notice and nag start na ako sa bago ko na work nung 1st week ng February 2015 and pasok pa ako doon sa 30 days notice. Nalaman din ng employer ko na may trabaho na ako andun lang kasi din ako nagtatrabaho sa same buliding ng dating kong pinag trabahohan. hinihingi ko nga sa kanila ang aking huling sweldo pero sabi nila forfeited na daw yon. may karapatan ba sila na i-forfeit ang sweldo ko under the philippines law or labor code kahit ako pa ang mali kasi pinaghirapan ko din kasi yon. kung ilapit ko ito sa DOLE sir tulongan kaya nila ako? ano po yong ibig niyo sabihin sa magpa-clearance?

Hindi ka pa din umabot ng 30 days notice dahil sa mga absent mo ng Jan 23-26, etc.

Ayon sa batas, dahil hindi ka nakatapos ng 30-days na pasabi o notice, pwede ka ngang kasuhan at hingan ng danyos. Pwedeng ang huling sweldo mo ay ang kapalit nun kunsakali.

Pwede kang tulungan ng DOLE, titingnan nila kung meron kang laban pero walang sigurado.

Magpa-clearance ka, humingi ng mga katunayan na ikaw ay nag trabaho sa dati mong kumpanya at hingin ang perang para sa iyo o magbayad ng pagkakautang kung meron man dahil sa iyong hindi pagtupad ng 30-days na notice.

pero wala kasi akong pinirmahan na kontrata sa kanila sir so pwede na hindi ko sundin ang 30 days notice? at kung saka-sakali man pwede ba nila ako ipa tangal sa bago ko na pinag tatrabahohan?

Kung wala kang pinirmahang kontrata baka ilaban nila na dahil walang papeles, wala ka din mahahabol dahil hindi sila employer mo.

ahhh ok sir pero ung ibang mga staff kasi naga reklamo kay hindi minimum wage ang sweldo nila and also ung sa akin hindi rin ako minimum wage kasi tinanong ko na ito before ang sabi nila below 10 lang daw ang total empleyado nila and by the law pwede daw nila hindi sundin ang minimum wage. tama ba yon sir? gusto ko din sana i-reklamo din ito sa dole aside from ung sweldo ko na hindi pa nila binibigay hanggang ngaun.

Anong uri ng negosyo meron sa kumpanya yan? manufacturing? retail or iba?

Depende sa kung anong negosyo ng kumpanya, at kung saang lugar, pwedeng mas mababa ang sweldo na binibigay.

Pwedeng mag file ang kumpanya ng request para sa exemption sa minimum wage lalo na kung naghihirap sila.
