Gud day po.. gusto ko po sanang itanong kung legal po ba kung ang nagkasal po sa nu ay secretary ng mayor but the signatory in our marriage certificate is the mayor itself , di po kc nakapunta ung mayor namin at may ibang appointment daw kc that day so ung secretary nya ang nagkasal sa amin..ikinasal po ako, 1997 (both age 23), civil wedding lang po and sa bahay lang namin ginanap ang ceremony.....17 years now but been separated just right after our civil wedding.. we never been together and live as husband and wife...Ikinasal lang po kami bec. I am pregnant and nakakhiya daw kc sabi ng mga magulang namin bec. Of my condition..still,  ive tried to save our marriage for the sake of our child.but then totally ayaw niya and  he totally abandoned us.. no financial support for my son totally until now..all i thought di nila nirehistro kasal namin dahil di naman kami nagsasama but hawak kc nila marriage certificate namin and pinaregister pala ng hipag niya...Year 2000 nabalitaan ko na ikinasal daw sya and nagkaanak.(totally with consent pa ng mga magulang niya). Hindi naman na ako naghabol coz whats the use?.. i on my part also been in a relationship year 2002 and may anak na rin. Gusto na rin po sana naming magpakasal at maging legal ang present relationship ko. Kung legal po kasal namin madali lang po ba ang magiging grounds for our annulment? your advice would be much appreciated.

Hi,

Dapat ang Mayor ang nagkasal sa inyo. Kung ang secretary ang nagkasal sa inyo, walang bisa ang kasal ninyo. Pero kailangan ay ipadeklara muna sa korte na walang bisa ang inyong kasal. Kung mahahanap mo ba ang secretary na iyon ng mayor na nagkasal sa inyo at pumayag siya na magtestigo para sa inyo sa pagpapawalang bisa ng kasal ninyo at may sapat kayong ebidensya kung nasaan ang mayor sa araw ng kasal ninyo, hindi kayo mahihirapan sa pagpapawalang bisa ng kasal.

Kahit na walang bisa ang kasal ninyo, hindi kayo dapat na magpakasal agad. Kailangan muna ipadeklarang walang bisa ang inyong kasal bago kayo magpakasal na muli.
