hi,

I would just like to seek advice if what case can I file or what do I need to do regarding my employer which is a BPO.
I was pulled out from taking phone calls and to do anything in the office (with pay) putting my status on HR meeting, however the case was dismissed by HR due to "no grounds" for any sanction, however the operations side is not accepting it due to HR not giving any emails or any documents for me to sign, but I'm still not reinstated to my position after more than 30 days suddenly my schedule that was tagged as HR meeting was removed but entirely removed from the roster of the campaign, again without any documentation now the HR people is not taking the responsibility regarding my pay and all the decisions that they are making, notice of decision for the case was not given to me as in no papers to sign at all. I find this as like dismissing me from the company but not to the exact point of dismissal. Thank you for your advice

i've already talked to my manager and she said that I was released by the campaign yesterday without giving me any notice and we did 3 hearings or conference regarding the alleged case but on thos 3 meetings e wala po talagang documents so the problem here is parang ginagawa akong laruan sa office dahil pinapapasok ako ng pinapapasok dahil may decision na daw for 40 days na pumasok ako kahit isnag decision na kelangan ko pirmahan e wala ako nakukuha

Hello po. Ang pabrika na aming pinapasukan ngayon ay nasa Caloocan City. Sa ngayon po, lilipat na po ito sa June sa Silang Cavite.

Ang tanong po, maaari po bang ipasok sa constructve dismissal pag kami ay pinilit na sumama? Kung sakaling magkabayaran po, ano po at ilang days ang aming makukuha.

Hindi yan constructive dismissal.
May karapatan ang kumpanya na lumipat kung saan nila gusto.
May trabaho pa rin kayo.
Desisyon nyo na lang kung gusto nyong sumama sa Cavite.

Nasa desisyon ng kumpanya kung gusto kayong bayaran dahil ayaw nyong sumama sa Cavite.

Opo naintindihan namin na karapatan ng kompanya kung gusto niyang lumipat sa Cavite pero di ba dapat isara niya muna niya ang kompanya niya sa Caloocan para kami ay mabayaran dahil iba naman na ang pangalan. Kasi kung hindi niya isasra ang kompanya niya sa Caloocan, patuloy pa rin kaming papasok

Wala ka naman nabanggit nung una na nag-iba ang pangalan.

Pero kahit ganun pa man, hindi yun sapat na dahilan.

Hindi rin nila kailangan isara ang kumpanya bago lumipat.

Pwede naman iwan bukas ang opisina sa kalookan habang naglilipat - at pagkatapos ay isara.

Sir Council pasensiya na po kasi noon una po bago po sila maglipat ng mga makina, ang sabi sa amin ay hindi magpapalit ng pangalan. Pero after nilang mailipat lahat ang makina, saka namin aksidenteng nalaman na nag iba na pala ng pangalan.

Di po ba pag magsasara ng kompanya, magpa-file pa ito ng notice of closure sa DOLE tapos may 30 days pa na ibibigay sa emplyeado to work upon receipt of notice. Ngayon po kasi walang sinasabi kung isasara ang Caloocan pero hanggang end na nalang ng July ang sinabing pasok ng mga hindi sasama.

Kaya nga po naguguluhan kami dahil hanggang end nalang kami ng July samantalang wala pa namang notice. Kung parehas sana ng company name ng caloocan at cavite, tanggap namin dahil nga hindi na kami makakasama.

Ang sa kanila po kasi kaya kami pinapatigil dahil ayaw daw naming sumama. Dahil ang pagkakaalam nila ay hindi namin alam na nagpalit na sila ng pangalan.
