We have this situation na may binibili kaming bahay, actually apartment type siya. ni-loan namin ito sa PAG IBIG. eto ang problema, yung 2 na unit sinangla-tira ng seller. nakalagay sa deed of absolute sale na after maibigay ng PAG IBIG yung loan proceeds namin sa seller which mababayaran na ng buo yung TCP eh  binibigyan pa namin ng 2mos para tumira sa 1 unit yung seller kasi para bigyan siya ng time na lumipat ( may 7 units kasi yung bahay). legal po ba na paalisin yung mga naka sangla-tira basta nabayaran na po sa seller yung bahay? panu po kung ayaw umalis nun naka sangla-tira kasi di pa tapos nun contract din nila sa seller? ano po pwede LEGAL na gawin?

Well bago binili ng new owner ung apartment they should have known na may existing contract which is ung sanlang tira if the new owner know it and still agreed to buy the property hindi dapat paalisin ung naka sanlang tira since from the very start alam nyong may ganun.

again, article 19 mga friends, paki basa sa baba...
ang naglapse dito eh yong unang owner, he failed or intentionally not mention the sanglang tira.
wala sa civil code ang details ng sanglang tira, so the right belongs to the new owner.(correct me if i am wrong please).
now, c new owner, dapat bigyan nya ng justifiable time is nakatira para makalipat, or if konting months na lang eh tapusin na lang ang contrata, para walang kaso kaso..
c nakatira, ang pwede nya habulin is c old owner..

Well kung alam kasi ng new owner during the time of sale ung existing contract about sanlang tira so therefore he/she should not just ask the tenants to vacate the property.

pwedeng pwede na itago ng old owner ang regarding sa sanglang tira,
at di obligasyon ni buyer na alamin yon, ang obligasyon nya, suriin kung talagang ke owner ang binibili nya,, as per mortgage,,, ang sinangla di pwedeng maging sa sinanglaan kahit pa napaso ang kontrata at di natubos, kailangan pa ng deed of transfer para malipat ang ownership..

as unang post, dapat tapusin yong 2 months na palugit na kasunduan nila ni seller, after that, all the rights na kay buyer na..
but then again, article 19 comes along.... me karma rin yan ika nga,,,,,

ang sangla tira ay matatawag din na pangungupahan, mas talo pa nga ang umuupa dito dahil pagbibitaw agad ito ng malaking halaga na mahigit sa buwanang upa at hindi pa naman nagagamit ng buo. May karapatan pa na manatili ang mga taong ito hanggat hindi natatapos ang napagkasunduan panahon ng pagalis at binibigyan pa ito ng grace period para makahanap ng bagong lilipatan.

Good noon po sa mga Adviser!

Thank you for this forum. Anybody can help me to solve my issue about "OLD OWNER" & "SANLA-TIRA".

Yung pong may-ari ng tinitirhan namin ngayon which is nakasanla sa amin worth of P350k, 2yrs of legal contract na pinirmahan namin at ng atty.
Ngayon po may planong ibenta ng owner ang buong house nya at kami ay nasa 3flr which is nakasanla sa amin at kami ay 7months pa lang nakatira doon, so may remaining 17months bago matapos yung contrata namin na 2yrs.

If ever po na ibenta nya ang house kahit hindi pa tapos yung contrata namin, aalis naman po kami kung maibabalik nya yung buong P350k namin.

QUESTION:
Pero lugi kami kasi hindi pa tapos yung contrata nmin same pa rin ang makukuha nmin na amount?
Anu po ang pwedeng gawin sa remaining months nmin? Ipapainteresan po ba nmin yung natira buwan na hindi ntapos ang contrata namin?

Thank you po, sana po ay may magbigay idea po sa issue ko pra pagdating ng panahon hindi po ako talo.
