Hello po. I am Jane. Andito po ako sa US nakabase. I just would like to ask some few questions. Yung papa ko po ay buhay pa. 80 yrs. old na siya. Meron akong 3 pang magkakapatid at ako yung eldest po. Eto ang deal namin ng papa ko. Since ako po yung laging nagpapadala ng pera sa kanya for almost 5 years at hindi tumutulong yung iba kung mga kapatid, gusto ng papa ko na ibigay ang lupa niya sa akin na worth 500 sq. meters. Ngayon ang kapalit niyan is magbibigay ako sa kanya ng 10,000 to 15,000 pesos monthly para sa maintainance nila ng mama ko sa mga gamot nila, sa bahay, sa pagkain nila ng mama ko, electric bills, water bills. Sabi ng papa ko, iisyuhan niya ako ng Deed of Absolute Sales para di daw makapagreklamo yung iba kong mga kapatid na kunyari ibenenta ng papa ko yung lupa niya sa akin kapalit ng 10,000 to 15,000 pesos monthly.....this will last hanggang buhay pa sya. Ngayon ang tanong is this: Since nandito ako sa America, at yung papa ko nasa Pinas....paano yung deal ng Deed Of Absolute Sale? Do i need to go to the Philippines para pirmahan yun or pwede ba ako magpagawa ng Authorization Letter dito sa Philippine Embassy na in behalf of me, I authorized my papa to sign all the legal documents? Paano po? Hindi pa po ako makakapagbakasyon doon as of this year.

complicated to,
1. una, di pwede ipagkait sa siblings mo ang kanilang right of inheritance.
kahit nabili mo na yan, or meron pang last will and testament,
mass me weight ang laws ng legal inhiretance...
2. di ka naman cguro US citizen na, kasi only Pinoys can own land in phil(dula citizenship, pwede)
3. Pwede special power of attorney, pero paano ang paglalakad ng transfer of name? at ibang proceso like register of deeds, LRA, etc.
4. sa Deed of sale, dapat reasonable ang price, if too cheap, papatak na donation na yan, at di sale..
consult a legal lawyer there or ask ur parents here to do the same

Ah ok....thanks for this idea.......pero its the owner of that lot na papa ko who is still alive and he is the one deciding not me......and i am willing to accept the offer.....if that is the case. At yung pagtransfer of name, kailangan pa ba na present ako doon...or pwede ba yung special power of attorney? Whats the disadvantage and advantages?

habang buhay ang papa mo, meron tayong tinatawag na legitime(di pwedeng ibenta ang property without reserving a portion for the heirs), the heirs can contest the sale, thus their share
(eto ang rights ng legal heirs), same thing pag nagpaalam ang papa mo, at meron will, (unless dis inherit ng papa mo siblings mo), at wala sa will ang legal heirs, pwede rin to habulin,,
pwede pa na merong kaunting share, pero kung walang share, case to...
if walang will, interstate inheritance to, at dito, pantay pantay hatian, regardless nag alaga or hindi.

mas maganda, gumawa na lang sya ng last will,,,
ilagay ang malaking share sayo, then mas maliit sa di naman nag aalaga,,,
basta meron slang share, pwede yon...

as for SPA, sino ang bibigyan mo ng SPA??
parents mo, eh cla rin ang seller ng property.
but as for other docs,
legal lahat ng transactions na ginawa nila in your behalf.
