may tanong lang po ako i hope matulungan nyo po ako..meron po akong uupahang apartment nagadvance na po ako ng 3 mants kaso po ung kinukuha ko po undef construction pa ang usapan po namin nung landlady after a month pwede na po kami lumipat but umabot na po ng 2mants now pero hndi pa po kami nakakalipat kasi hndi pa po tapos but ngaun po patapos na po ipagawa kaso ang gsto naman po nung me ari taasan daw po ung monthly rental dahil kung hndi daw po ibbigay daw po nya sa iba...may karapatan po ba akong legal for this situation..

meron ba kayong written agreement? contract kung baga?
una, delay cla sa usapan,
then binding ang unang napagkasunduan,,
once natapos 3 months, meaning nagamit nyo property nya, pwede syang magtaas, nsa inyo kung gusto nyo pa or hindi na.
tama, settle nyo sa barangay, kung saan andoon ang property.

if di pumayag, patubuan mo ang perang binayad mo

dalhin mo sa barangay yang agreement nyo...

ang invoke mo dito, yong nakapaghanap ka sana ng ibang lugar if wala kang contract,
or nagamit sa ibang bagay ang pera mo...

yes po attorney maliit lang po...6k monthly bale 18k po naibigay ko po sa me ari..this is a big help po tlga attorney thank you so much..ang hirap po kasi maghanap nagextend na nga po ako dto sa apartment na tinitirhan ko po kasi po kinonsider ko po ung one month na hndi po nya napagawa ung apartment...and then bigla po ganito na po ung magiging situation basta lang po nya ibibigay sa iba because of higher rental..and ang big problem ko pa po 10days more na lang meron ako dito sa tinitirhan ko po..

if me time ka, basahin mo ang Civil code starting article 1156.. regarding contracts...
then saka mo sya dalhin sa baranggay, para meron ka bala, bago ka pumunta sa gyera

sang lugar ba yan, parang ang mahal naman ng 6K,
how many rooms?

alabang area po attorney..mahal po ba yung 6k?ang gusto pa nga po nya ngaun gawin pong 10k ang monthly rental po namin..wala po xang room bale up and down po xa if ever daw papagawa ko ng room ung taas ako na daw po gagastos dun...

may tenants rights and terms sa mga ganyan.. teka hahanapin q..

kung commercial yan pwde yan sa 10k. pero kung ganyan lng? thats too much..

opo attrorney parang raw house but along hiway naman po pero residential po xa attorney pero po ung ibaba pwede po lagyan ng maliit na tindhan since along hiway naman po..wala pong room attorney bale ung taas po open lang po xa na pwede na po tulugan..pero wala pong partition na room..hndi ko po alam ung exact lot area pero maliit lang po ung house..

The limit on increase of rent amount:

The Rent Control Act of 2009 (R.A. No. 9653) states that the lessor or the landlord is not allowed to increase the rent more than seven (7) % annually if the unit is occupied by the same tenant. The lessor is only allowed to change the rate for new tenants once the unit becomes vacant.

Coverage of this law:

This act applies to residential units in the National Capital Region and other highly urbanized cities which rent at or below ₱10,000; and ₱5,000 or below in all other areas in the country.

Advances and deposits:

Stipulation on deposits and advances has also been included in The Rent Control act of 2009 which further states that a lessor cannot demand from the tenant more than one (1) month advance rent and more than two (2) months deposit. Any accumulated interest of the deposit shall be returned to the tenant upon expiration of the rental agreement.

However, this amount may be forfeited in instances where the tenants failed to settle outstanding utility bills such as electricity and water. This amount may also be forfeited and used to pay for damages done by the tenant to the property.

Penalties for violations:

Persons, whether natural or juridical, who are found to have violated any of the provisions of this Act will be subject to a fine of not less than ₱25,000 but not more than ₱50,000.00, or imprisonment of not less than one (1) month and one (1) day but not more than six (6) months, or both.

yan na nga lang po siguro attorney ang best thing to do...kung hndi lang talaga ako nakacommit sa kanya at hindi na ako gahol sa time hndi ko na itutuloy paglipat po...iconsume ko lang po ung naibayad ko sana lang po pumayag na palipatin na po kami since tapos na din po gawin..or if ever po attorney hndi nya ako palipatin anu po ung best na pwede ko pong gawin dun sa binayad ko po sa kanya..pwede ko po ba xang singilin ng interest for that if ever gsto nya ibalik na lang po ung naibayad ko.
