q1: in a lot dispute between neighbors,
neighborA accuses neighborB of encroachment, who shall pay the land surveyour to determine if encroachment really happened?
Q2: can neighbor1 force neighbor2 to agree to terms that whoever lost the argument, will pay the surveyour?

its crystal clear kung sino ang may interes sa lupa ay syang mag conduct at mag efort ng papa survey nito upang mapatunayan alin man sa kanyang pag aangkin sa lupa.

its a similar case sa pag kakaron ng ibang survey map ng lupa kumpara sa mother title nito. since may nag oobject dahil sa lumiit ang bahagi ng kanyang lupa na ayun sa kanyang titulo na hndi umakma sa mother title ng subdivision.

since sya ang nag hahabol? sya ang nag efort mag pasagawa ng muling pag papa survey to clear things.

Sorry po.. Offline po ako kaya hindi na nakapag reply. Na appreciate ko po lahat ng naisulat nyo sa issue ko. @LandOwner12, maraming maraming salamat sa efforts ng pagresearch mo.

Clarification po:

Nung binili po ang lupa namin, yung may ari po ang nagpa survey at sila na rin po nagpalagay ng muhon na tinayuan po namin ng mataas na wall. so etong wall na to, based don sa muhon nila syempre lalo at that time, yung binilhan namin na tao which is a half brother of this person claiming his 15 inches, ay nagbabantay pa nung tinayo yung bahay namin.

So kami we only followed po kung ano ang sa amin tapos bigla ngayon after 25 years, they na nagbenta sa amin is claiming this 15 inches.

Okay..so let's say po that we indeed exceeded 15 inches. Please take note again na sila nag pa survey and merong muhon. Tapos kukunin nga nila the 15 inches. So sisirain nila yung wall namin and lahat ng nandun sa 15 inches. Now, wala naman kaming kasalanan kasi again sila nagpasurvey nyan nung binili namin and sumunod kami sa muhon, ibig sabihin ba nito babayaran nila yung worth ng sisirain nila sa 15 inches na yun? Or give up nlng namin ng parang wala lang? When kung alam namin that we exceeded, hindi naman sana namin yan aangkinin.

Inaabala po nila kami sa issue na ito na sila naman ang may kasalanan. Ididiin ko again, sila nagpasurvey, meron muhon. And then out of the blue after 25 years, guguluhin nila kami. Kukunin nila yung 15 inches, sisirain nila kung anong meron don. Mawawalan kami kung anong meron sa 15 inches sa pagkakamali nila? And kami talaga zero dito sa hindi namin pagkakamali?

wala clang proof sa cinasabi nila..
kung gusto nila ma prove, magpasukat uli cla, cla magbayad.
yong mga events na sinasabi mo eh self serving yan sa court, unless merong kang black and white na documents.

wag mo muna probleman ang wala pa naman,
tingnan ko lang kung gumastos cla para maclaim ang 15 inches nayan.
after nila magsukat, at napatunayang tama cla, saka ka balik...

then sige.. ganun na lng gawin at yon naman ang tama.. sya may interes sa sinsabing kanya daw? eh di sya gumastos. if proven na kanya nga yon? then face the fact and consequence..
obligado sirain ang pader nyo dahil lampas nga kasi kayu sa dapat na sa inyo. then if not at lumalabas na inyo pla talaga yon?

then ask danyos na lng sa abala gaya ng nabanggit mo kanina..

sang ayon ako na kung sinong naghahabol sya ang gagastos.... but once na mapatunayan nung naghahabol na sa kanila talaga ung lupa pwede nya singilin ung ginastos nya sa pagpapasurvey. opinion ko lang po.

hindi makatulog so nag basa (parang tv series

2 cents from a lady walang alam tungkol sa law... I will take the shoes of the agrabyado kuno na neighbor. I am claiming 15" encroachment (wow ). What to do? Kuha ako surveuor and pay for it.

Result = mali ako .... I just crawl back sa cave ng mga roaches and shut up.
= tama ako .... humanda ka dahil vindictive ako.

who will pay for re survey is nit picking. on the other hand kung ako Si beauty roach (oooooooooooops Rose) I sit in my corner ala Mayweather and do nothing. Sit and and wait.

Opinion lang po. Wag ninyo akong dikdikin hehehehe
