Dear Sir/Mam,
Nov of 2004 naghahanap kami ng bahay hanggang sa nakilala nakakita yung mama ko at kapatid ko..since yung bahay ay amounting to 2million since 1million lang po ang kaya namin ibigay at hindi po kaya namin ibigay yung buong pera nagkaroon po ng condition yung may ari..sa loob ng isang taon babayaran namin yung bahay..bago p magmid ng nov nakapgdown napo kami at gumawa napo ng deed of sale...nagkaroon po ng kondisyon na pagnaibigay napo namin yung kalahati ng kabuang presyo nung bahy aalis napo yung may-ari at mag momovein napo kami..nangyari po iyon..nakapgmove-in napo kami ng dec..sinabi po sa amin ng may-ari ng bahay na nawala po yung title nung bahay kaya nagpagawa po kami kasama yung may-ari ng bahay ng affidavit of loss na nakasaad po dun na nawala yung title ng bahay pero may kopya po sila ng certified thorugh copy. naka attched po yun sa deed of sale..lately po ng around of april wherein magbabayad po ulit kami sa sa balance sa bahay at dahil sa malapit narn kaming makbayd ng buo..humingi ang mama ko sa RD ng kopya ng title dun po namin nalaman na isinanl yung bahay pagkatpos magkaroon ng contract sa amin yun may-ari ng bahay..kay ang ginawa po ng mama ko siya napo naglakd para mabayaran yun tax, certifacte to transfer at nabayaran namn po at naitransfer yung mga resibo..bali ang kulang nalang po eh yun title e malipat po sa pangalan ng mama ko..hindi nga po matransfer dahil isinanla ng may-ari..anu po ba ang dapt gawin ng mama ko sa bagy na ito..dahil natatakot na baka mamaya ibenta nman ng dating may-ari yung bahay na kami ang unang nakabili..sa isang banda po naistop tuloy yung condition na mabayran yung bahay sa loob ng isang taon nung malamn namin na isinanla sa iba yung bahay na alomost paid napo namin..hindi rin po sinabi samin na pagtapos po magkaroon ng agreement samin ng may-ari ay sinanla nay po sa iba/ anu ba ang dapt gawin dun..5 years napo kaming nakatira sa bahay na yun hanggang ngayon..nagkaroon narin po kami ng malaking renovation sa bahay..hindi napo kami nakapgusap nung may-ari simula ng malaman nila na alam na namin yung ginawa nila..hindi na muna po kami nagfile ng case dahil iniintay po namin makipag-usap yung may-ari ng bahay..sa part namn po nung pinagsanlaan labas daw po siya dahil ang kausap niya yung nakapangaln dun sa title ng lupa at bhay..any advice po for some legal help and action? maraming salamt po at pagpalain kayo ng Poong MayKapal....

you should immediately inquire with the seller and the mortgagee what happened. are you still in contact with them?

if the seller does not pay the mortgagee, the latter will try to foreclose on the property. you will have to file a case to prevent the foreclosure. you should provide evidence that the mortgagee knew or should have known that someone else was occupying the property. i asked if it was a bank because banks are required to check.

you can also explore filing an adverse claim now on the title, but this will not immediately affect the mortgagee's rights.

alam naman po ng pinagsanlaan ang nangyari at alam din po na nakatira na kami dun sa bahay dahil nagkausap po sila ng mama ko.sinabi nga po na ang kausap niya dun yun dating may-ari..ang first step po naming gagawin is magfile ng case sa dating may-ari para hindi maibenta yung bahay ? malaki po ba ang chance namin dahil nasa amin naman po lahat ng receipts na tumanggap sila ng pera samin at nag execute pa sila ng affidavit of loss at yung deed of sale po at yung pera na ibingay napo namin sa kanila is almost paid napo yung bahay? tapos mas nauna po kami bentahan ng dating may-ari ng bahay kesa dun sa pinagsanlaan?...hindi po kasi namin alam yung address nung dating may-ari po eh nagtago na siya..salamat po atty sa napakalaking tulong po ninyo pagpalin po kayo..wait ko po advice niyo?

the important thing to prove is that the mortgagee knew about your occupation of the house before he entered into the mortgage. it is his right which is inscribed on the title to warn others, yours has no notice. good luck.
