Hi Sir/Ma'am. Good day! Meron po ako guinarantoran sa isang lending company last year wherein sya din po ang guarantor ko kasi sabay kaming nag apply for loan. Last year November, I finished my loan at nag renew po ako ulet ng loan pero iba na ang guarantor ko. Pero yung guinarantoran ko hindi pa sya tapos sa loan nya dahil nag resigned sya sa company, thus, wala akong update sa kanya the time na nag resigned sya which is October last year. Feb-April this year lagi ako tinatawagan ng lending company na kapag hindi daw nagbayad at nakipag coordinate sa kanila yung guinarantoran ko ay sasampahan daw kaming dalawa ng legal case at pupunta sa aming barangay. I asked for the number of the person na guinarantoran ko and i kept on texting him but to got no response at all. During those months ako ay naka leave because of pregnancy at dahil nag ayos din po ako for my wedding. So every payday wala silang nawiwithdraw sa atm ko coz i was on indefinite leave. Kinakaltas nila ngayon ung hulog ko sa co maker ko (ibang person) pero after two days naman ibinabalik ko dun sa co-maker ko yung kinaltas sa kanya. Lagi din ako sinasabihan ng lending company na lagi nlang daw walang laman atm ko (malamang kasi nga naka leave ako at alam nila yun). Isama ko na din daw sa pag aayos ng wedding ko ang paghahanap ng lawyer ko dahil palaging ganun. It causes so much stressed sakin the way na magtext sila. I finished my loan this May 30 and i asked them kelan nila ibabalik yung atm ko (as collateral). At first sabi ng collector agent ibibigay nya sa asawa nya pra maibigay sakin (ung asawa nya officemate ko po dati at malapit lng kasi office nya samin). Ive waited for that day na sinabi nyang ibibigay ng asawa nya pero wala so i again texted the collector agent ang sabi nya d pa daw bnibigay ng office nla so i texted instead the manager kasi po i need my atm back kasi ilang araw nalang payday na ulet. The manager told me na hindi daw ibibigay ang atm ko hanggat hindi pa tapos magbayad yung guinarantoran ko last year. So nagulat ako na hindi pa pala tapos magbayad yung guinarantoran ko at lalong nagulat ako na may ganun pala silang policy na hanggat hindi pa tapos magbayad ay hindi ibibigay ang atm ko? What i did is pina block ko ang atm ko to get another atm. Reason is that i need a momey dahil manganganak pa ko. Also, i dont know the whereabout of the person na guinarantoran ko so kung ikakaltas nila sakin whats my assurance na babayaran ako nung guinarantoran ko cause i also need the money. I asked for the updated number of the person na guinarantoran ko. He replied to me and found out na nagbabayad pa pala sya. But then someone from legal office "daw" ng lending company called me at kung ano ano ng sinabi sakin. They are forcing me to surrender my new atm dahil hindi pa nga tapos magbayad ung guinarantoran ko. First, why would i surrender my atm eh nagbabayad pa naman pala yung tao. They even told me na sigurista daw aq dahil ayoko makaltasan at tinatakasan ko responsibilidad ko as guarantor. Hindi ko po tinatakasan kasi nagbabayad pa naman ung tao. Aside from the call i received, they also kept on texting me. They even called me sinungaling. At dahil sinungaling daw ako malamang ginagawa ko din daw un sa ibang tao. I told them that they are not in the position to call me singungaling dahil kung sinungaling ako di ko na dapat tinapos utang ko sa kanila etc. Even Sunday they are texting me which i believed wala silang office but instead ang sagot sakin "just to let you know we have office from mon-sun. They even asked me nastress na daw ba ako (kasi po im pregnant) eh ano pa daw sila sa ginagawa ko sa kanila. Pag d daw po ako sumunod sa policy nila at isurrender ang atm ko papa NBI hit daw nila ako para hindi ako mahanap ng bagong trabaho dahil sa ugali ko. Gamitin ko din daw ang brain cells ko baka sakaling mablessed pa ko. Lahat po ng text messages nila sakin ay naka saved. Till last Monday may nagtext saking Atty daw sya at nakarating na daw sa kanya ang reklamo ng mga kliyente nya from that lending company. Isurrender ko nalang daw ang atm ko para wla ng problema. I told him na mag file din ako ng case "harassment". Sabi nya its my right to file a case anytime but thats a different issue daw dahil ang issue dito ay sa contract ko. How come its a different issue eh kaya nga nila ako hinaharass dahil sa contract na ipinipilit nila where infact nagbabayad pa ung tao..dinala na daw sa fiscal yung kaso. Sila daw may panggastos sa kaso ako daw ay wala dahil wala nman daw akong pera kaya isurrender ko nalang daw atm ko. Please advise me po what to do. Sobrang nastress na po ako

Consider the following when signing as a co-maker:

What is a co-maker?
A co-maker is a person who, by contract, promises to pay another person’s (principal borrower) loan if that person fails to do so.

Is a co-maker required in all transactions?
Different lending institutions (lenders) have different policies.  A lender may require a co-maker if the principal borrower is unable to meet its credit criteria.  A co-maker does not necessarily receive or benefit from the proceeds of the loan but is equally responsible for ensuring that the full amount of the loan, including interests and other charges, is paid.

When the principal borrower fails to pay the loan, is the co-maker required to pay it?
Yes, the lender does not need to proceed or collect first from the principal borrower and may immediately take the following actions against the co-maker if the principal borrower is unable to pay:

• Collect the full amount of the loan, including interests and other  charges, from the co-maker; or
• Sue the co-maker along with the principal borrower in an attempt to collect payment; and
•  Demand the payment of late fees or collection costs from the co-maker

What is the remedy of a co-maker who is made to pay the loan and the interest thereon?
The co-maker can demand the principal debtor to reimburse whatever amount he was made to pay.

since hndi na nakakapag bayad si principal barower. ?

kya na kay co-barower na ang responsibilities.

the best thing to do is inform mo si lending allm about and whereabout ni principal barower. substitue sa resp si co-maker once hndi nila ma force si principal ng pag babayad.

may point ka kung harasment na ang ginagawa sau and foul tactics na ang ginagawa ng agent sau sa pag collect ng payment.

pero may point din sya and tama sinsabi nya na thats another isue kung mag file ka againts to them.

kaya lng kasi pumirma ka bilang co-maker or co-barower at ang pag pirma ay indication ng

"pag sang-ayon" sa responsibilidad bilang isang comaker.

and if ikaw ang lahat ang mag shoulder ng dpt na kay principal?

then this is another issue. atleast karapatan mo naman na mabawi lahat even a single cent na binayad mo na dpt ay si principal ang mag bayad.

now this is now sa pagitan naman ninyong dalawa ni principal at ikaw bilang co-maker ang usapan.

Pero po kasi nakatext ko po yung principal debtor last saturday and according sa kanya nagbabayad pa sya..in two months matatapos na sya..so bakit pa po ako kinukulit ng lending company na to at pinipilit isurrender ung bago kong atm?besides nagtext po sila sakin at sabi na elevate na daw sa regional trial court ung case ko. Pero nung tinawagan ko yung attorney nila ang sabi nya sa maliit lng daw na korte nila isinampa ang kaso. So nag sisinungaling po sila. At bakit ako po ang ginigipit nila ng ganto eh nagbabayad pa nga po yung primary debtor

first im not a lawyer ha.

imo.. kya ikaw ang hinaharas nila kasi ikaw ang naka bukas ang comunication sa kanila.

isa sa advantage ng may co-buyer or guarantor is may option-2 sila na pwde habulin kapag hard to reache yung principal debtor.
remember that agents from legal aid and debt collecting offices are very agressive. yes they can sue you for this pero in accordance naman yan sa right term.

they are just aftering a cholateral to ensure na makaka collect sila every collecting date. sadly.. sau sila naka focus dahil maaring hndi nakikipag comunicate ang principal debtor.

and things get easy for them dahil na haharas ka nila.

anong kaso daw ba ang isasampa sau?

hndi naman maaring estafa kasi hndi nyo naman tinataguan at katunayan eh nakikipag setle pa nga ikaw at negotiate yta diba?

so wlang estafa sa ganun kasi ang elemento nito ay kapag may halong pang loloko kapalit ng pera or pag tatago matapos makuha ang pera. o pag gamit ng maling identity para maka panloko or pag talbog ng tseke na may halong pananadya..

sa collecting sum of money naman is may figure of amount na tinatanggap. if im not mistaken 400k yta??

then if less than 100k ang perang pinag uusapan?

they can only lift the case sa small "claim court"

hndi ito kasong kriminal kya wag matakot kung sakali. itoy isang paraan lng ng korte sa pag kakasundo ng paraan ng pag babayad ng nangutang at inutanagan.

ano daw bang kaso? at mag kano?

Hi sir raheemerick thank you sa advise. However, may contact pa sila kay principal debtor so bakit ako ang ginigipit nya. Besides, na traced nila kung saan nagwowork ngayon c prinicpal debtor. Aside from that, i was able to contact also the principal debtor dahil yung lending mismo ang nagbigay sakin ng number nya. As per per the principal debtor nagbabayad pa sya. So whats the point na kung ano ano sinasabi nila sakin? The lending texted me na inelevate na daw nila sa regional trial court ung case ko. I went to RTC and found out na wla pang kasong naeelevate sa kanila. I called the lawyer of the lending company na ngtetext din sakin and he said na hndi sa rtc inelevate ung case kundi sa small court lang. If thats so, nagsisinungaling sila. Aside from that anong ikakaso sakin eh nakakausap pa pla nila ung principal debtor?

So dahil nagdecline si principal debtor ako daw ang kailangang magbayad. What?ako agad porket nagdecline si principal debtor?eh may trabaho nga sya meaning he still has the capacity to pay. kung magharap sa low court, eh di humarap, at di ikaw ang hahabla nila, kundi c principal debtor,
