Magandang araw po!

Kasal po ako sa aking asawa ng halos mag-24 taon at may 2-anak na malalaki na, isang naka-tapos na at isang magtatapos sa kolehiyo.

Ang unang 5-taon naming pagsasama ay masaya at very-much inlove sa isa't-isa at pareho kaming kumikita, subalit na-depress ang aking misis ng mawalan siya ng hanapbuhay at naubos ang kaunting ipon namin hanggang dalhin namin sya sa mental institution at naging out-patient.

Nagbago ang lahat sa buhay namin, mula nuon naging kalbaryo ko na ang aking misis, madalas makipagtalo, nagiging erratic ang behavior at kung minsan ay nagbabanta na magpapakamatay o susunugin ang aming bahay. Nawala ang aking social life at bihira ng makipagkita sa mga kaibigan dahil laging ina-away ng aking misis sinuman na maging malapit sa akin ke lalaki o babae man. Itinuon ko na lamang ang aking buhay sa aking hanapbuhay, hiwalay na din kami sa pagtulog ng halos 15-taon na. Dumaan na din kami sa maraming marriage counseling subalit nauwi sa wala. Bihira na kaming mag-usap kung mag-usap man ay tungkol na lang sa mga anak namin.

Maraming business at hanapbuhay ang sinubukan ng aking misis subalit hindi sya nagtatagal, minsan ay linggo o buwan lang ay uma-alis sya sa trabaho dahil may nakaka-away o hindi nakaka-sundo, palaging ganuon at hindi siya nagsasawa ng palipat-lipat. Hindi na rin sya nakikinig anuman ipayo ko sa kanya.

Gusto ko ng maka-alpas sa ganitong kalagayan, ano po aking gagawin? Posible bang ma-annul ang kasal namin at lumigaya naman ako sa piling ng iba kung may magkakagusto pa sa akin?

anullment ba ang hanap mo base sa pscy incapacity?

siguro posible. magastos at mahaba habang proseso ang haharapin mo kaya magisip isip kung yun nga ang ikaliligaya mo at baka magsisi sa huli.. careful careful Smile

Gaano po kaya katagal ang proseso ng annulment? Aabutin kaya ng 1, 5 o 10-taon? Magkano naman po kaya ang aabutin?
Balak ko pong subukan kaysa naman habang panahon akong ganito na umiikot na lamang ang aking mundo sa trabaho at bahay, walang masyadong kaibigan na maka-kwentuhan dahil sa kahihiyang dulot ng aking maybahay.

Grounds for annulment of marriage?

Annulment of a marriage should be rooted on the specific grounds enunciated in law and jurisprudence. The grounds are:

1. Absence of Parental Consent. A marriage was solemnized and one or the other party was eighteen (18) years of age or over but below twenty-one (21) and consent was not given by the parents, guardian or person having substitute parental authority. The Petition of Annulment must be filed within five (5) years of having attained the age twenty-one. However, if the parties freely cohabited with the other as husband and wife after having reached the age of twenty-one (21) a Petition of Annulment can no longer be filed.


2. Mental Illness. One or the either party was of unsound mind at the moment of the marriage. But if the parties freely cohabited with each other after he or she came to reason the law prohibits the filing of a Petition.

3. Fraud. That the consent of either party was obtained by fraud, unless such party once having knowledge of the fraud freely cohabited with the other as husband and wife. The petition must be filed within five (5) of finding out the facts of the fraud.

4. That the consent of either party was obtained by force, intimidation or undue influence. Except when the same has ceased and the party filing the petition freely cohabited with the other as husband and wife. The injured party must file within five (5) years from the point in time the force, intimidation or undue influence disappeared or came to an end.

5. One or the other party was physically incapable of consummating the marriage, and such incapacity continues and appears to be incurable. The filing of the Petition of Annulment must be filed within five (5) years after the marriage.


6. Either party was at the time of marriage afflicted with a sexually-transmitted-disease (STD) found to be serious and seems to be incurable. This may also constitute fraud. The filing of the Petition of Annulment must be filed within five (5) years after the marriage.

Base po sa pagkaka-intindi ko sa number 2 "Mental Illness" sa panahon ng kasal ay may mental illness na ang isang partido.
Lumabas po kasi ang mental illness ng aking misis  5yrs after ng kasal namin ng dumaan sya sa depression, pero bago po yun, ilang buwan lang pagkatapos namin maikasal ay naka-kitaan ko na ng kakaibang pag-uugali ang aking misis, gaya ng sobrang pagkagalit, kahit ang kanyang sariling magulang ay minumura nya kapag sila ay nagtatalo, nilayuan na rin sya ng sarili nyang mga kapatid at magulang dahil sa kanyang behaviour at kami ng mga anak ko na lamang ang nagtatyaga sa kanya at nagsa-suffer sa sitwasyon.

Yung number 5 naman na "Physically Incapable", katumbas din po ba nito ang "psycological incapacity' na dahilan para ipa-annul ang kasal?

Saka absolute po ba yung 5-yrs na yun after ng marriage?
