ANG COOPERATIVE AT AKO AS SELLER HINDI NA PO KAMI NAGKULANG SA KANYA, UMALALAY NA NGA AKO SA KANYA..KASI ATTY MAY PATAKARAN PO ANG COOP SA LAHAT MEMBERS NA KUNG IBENTA NILA ANG LOTE, YUNG BUYER PO NA INTERESADO MAG-ATTEND PO NG MEETING, PARA MALAMAN DIN NILA YUNG HISTORY DITO AT MASAGOT NG PRESIDENTE AT IBANG OPISYAL ANG MGA KATANUNGAN NILA.

what is important here is what is written in your deeds of sale. is anything there written about the coop?

is this some form of community mortgage program? is there litigation covering the property?

OPO ATTY. CMP PO ITO BEFORE PERO FULLY PAID NA PO, WALA PONG LITIGATION.
ATTY, ANO BA GAGAWIN KO? SOBRA NA KASI PERWESYO NILA SA AKIN, NAKAKA-STRESS, DISTRESS, DISTURBO, NAKAKAPAGOD ATTY. SA INTERNAL USAPAN NAMIN NG JAPAYUKING ITO, IBENTA NAMIN ULIT, PAG MAY BUYER KAHIT MAG-BIGAY NG DOWNPAYMENT, OK LANG, GAWA AKO NG CANCELLATION OF DEED OF SALE, PERO HINDI MO NA NYA IBIGAY ANG TITULO..SYEMPRE ATTY. so deed of sale is between coop and buyer? not you and her?

what you need to make them do is to make them pause and look at their situation. what i would recommend is that you or your lawyer write to them to explain how this whole transaction was conducted, and the implications of purchasing a property under a CMP. you should also explain that their aggressive tactics should stop or else you will initiate a case of unjust vexation and threats against them. end with the fact that you have found a buyer and if they refuse to accept the offered terms, you will leave them as they are and consider the contract binding and the matter closed.

SALAMAT SA ADVICE ATTY. TALAGANG ANG LAKI NG PERWESYO NA BINIGAY NYA SA AKIN,SINCE MARCH 2010 MALAKI NA RIN MGA GASTOS KO SA PAG-START ALL OVER AGAIN SA PAG-TRANSACT NG IBAT-IBANG MGA BUYERS AT MGA AHENTE,SA XEROX PA LANG, LOADS KASI PO NAKA-ADD PO SA INTERNET, PARA LANG TALAGA MABENTA ULI AT MAIBALIK ANG AMOUNT SA KANYA, AND SHE'S DOING NOTHING, TAPOS BIGYAN PA NYA AKO NG 4 MONTHS NA MABALIK KO YUNG AMOUNT, HINDI NYA INISIP NA REAL ESTATE YAN HINDI PO PAGKAIN OR MGA ISDA NA IBIBENTA KO SA PALENGKE.

THAT'S ALL I WANT FROM THEM, KASI PO HINDI BIRO ANG MAKIPAG-TRANSACT, EXPLAIN NG EXPLAIN HANGGANG GABI PA NGA MAY MGA BUYER PANG-GUSTONG TUMINGIN SA SITE LALO NA GALING PROVINCE.

TAPOS ATTY YUNG DEED OF SALE NAGING FRAUD OR FALSITY YUN KASI YUNG AMOUNT NA NAKALAGAY DON HINDI ANG AMOUNT NA PRICE NG LOT NA BINAYAD NYA SA AKIN. 500,000.00 BINAYAD NYA SA AKIN, 250,000.00 LANG NAKALAGAY DON.

moderator
a contract with a wrong price is not strictly speaking a falsified document. it is called a relatively simulated document where the parties still intend to be bound by the agreement in spite of the wrong price. if you had nothing to do regarding its preparation then you have nothing to worry about, but the consequence is that, if proven, the parties can be liable for tax evasion.

Maraming maraming salamat po sa advice atty, talagang malaki po ang tulong nyo, ngayon po hanap pa rin ako ng buyer, kasi po umatras po yung dating sure buyer, mag-down na sana ng 450,000.00, isa lang kasi request ng buyer na ipa-kansel lang yung deed of sale,pero hindi pa nya kunin ang title, napag-usapan na rin namin yan ng japayuki last august2010 kahit mag-down lang ang buyer, hindi pa kunin yung title. Pumayag naman sya at may e attach lang ng kasulatan galing baranggay or coop para may security rin sya.
Pero nung mag-down na ang buyer atty. nagpagawa na ako ng cancellation sa lawyer,kasi po kampanti po ako kasi napag-usapan na namin yan, gabihan tinex ko sya, Taka na lang ako atty pumunta na ng barangay may kasama, kasi atty kahit sino na lang yang atty in fact nya kahit sino hilain nyang tao para taga-pagsalita nya.. ayaw na naman nya, kasi gusto nya ng CASH, according po sa speaker nya.

Maraming salamat atty, sa pag-basa nito, talagang na iinis na ako dito atty. gusto lang ma express yung inis ko..500,000.00 yung bili nya sa akin gusto nya 600,000.00 isa-uli ko sa kanya..
Ang ginawa namin ngayon sa coop diplomasya muna atty. hanggang sa matiis pa.
