Ang annulment of marriage o declaration of nullity of marriage ay isang proseso na dumadaan sa korte kung saan ang mga desisyon dito ay maraming epekto. Isa sa mga epekto ng desisyon ng korte sa annulment of marriage o declaration of nullity of marriage ay ang pagbabago ng status ng mga anak ng mag-asawa. Kung pabor ang desisyon ng korte sa annulment of marriage o declaration of nullity of marriage at pinawalang bisa ang kasal ng mag-asawa, isa sa mga epekto nito ay magiging status ng kanilang mga anak depende sa ground na ginamit sa proseso.

Kung ang ginamit na ground sa annulment ay ang mga ground sa Article 35, 37, 38 and 45 like lack of marriage license, lack of authority of solemnizing officer, bigamous marriage, under age marriage, ang mga anak nila ay magiging illegitimate child. Pwede gawing legitimate o lehitimo ang kanilang anak sa pamamagitan lamang adoption process sa korte at wala nang iba at isa lang sa mag-asawa ang pwedeng mag-adopt sa kanya at pwede silang sabay o magkasunod na mag-adopt sa bata. Dahil magiging illegitimate child ang bata, ang custody nito ay mapupunta sa kanilang nanay under Article 176 ng Family Code unless may ibang order ang korte sa desisyon ngannulment of marriage o declaration of nullity of marriage.

Ngunit kung ang ginamit na ground sa annulment of marriage ay Article 36 (psychological incapacity) or 53 (non-recording of court's decision), ang status ng kanilang anak ay mananatiling legitimate child ayon sa Article 54 which states: Children conceived or born before the judgment of annulment or absolute nullity of the marriage under Article 36 has become final and executory shall be considered legitimate. Children conceived or born of the subsequent marriage under Article 53 shall likewise be legitimate.
