gud pm, pede nyo po b aq tulungan regarding s kaso ng mga relatives ko.. nasagasaan cla ng 10 wheeler truck nun June 19, 2014, sa Nueva Ecija.. ang driver nakapag bail po ng 15k lng at ung truck nkapag bayad ung may-ari kaya narelease rin after a week simula ng nangyari ang aksidente.. On going ngaun ang hearing.. may laban po b kmi kung itutuloy p rin nmin ang kaso.. ang tumatayong abogado po nmin eh ung fiscal dun n may hawak ng kaso.. nkikipag usap ngaun ung emisaryo nung kompanya pero ang inooffer lng nila kulang p po dun sa ginastos sa dalawang nmatay nming kaanak... prang ipinapa intindi nila na ang driver lng ang my obligasyon n mag bayad sa mga damages.. dipo ba dpat ung kompanyang pinag tatrabahuan nya eh my obligasyon din dun sa aksidente. ksi po ung truck n minamaneho ng driver nya ang naging dahilan ng aksidente... Sana po matulungan nyo po kami mag decide kung dapat nming gawin.. Maraming salamat po..

Yes, ang company may liability din. Pwede niyo rin sila kasuhan ang company ng civil case for quasi-delict. Kaya lang kailangan niyo ng abogado para diyan.

Sa criminal case, kahit di isali ang company ay liable pa rin sila. VICARIOUS LIABILITY yon.

You cannot hold the company liable if it is a criminal case. It is personal to the driver. Vicarious liability is under Quasi-Delict under the civil code.

That's exactly what I'm saying. You cannot hold the company primarily liable if it is a criminal case. The subsidiary liability of the employer will only arise upon conviction of the employee and upon proof of the latter's insolvency. Why wait that long?

Filing a separate action for damages (vicarious liability of employer) under the civil code is the most practical legal remedy to go after the employer because proof of conviction of the employee is not necessary.

Does the same applies if ever naka disgrasya yung driver pero hiniram lng nya sasakyan? Sa ibang tao nakapangalan ung kotse.

Bale hiniram ni driver ung kotse kay juan pero si juan ang kinasuhan kc sa knya ung sasakyan. Pede ba ganun? May liability ba si juan kahit indi sya ung nag mamaneho nung time ng disgrasya?
