Hi Atty,

Sad to say I’m a victim of unconscious husband for more than a year now. Oct. of 2009 when I first found out his infidelity thru his cellphone he admitted that he’s having an affair since July with the other girl whom he met in social network. He made me believed that he will cut his affair with the girl and that madali lang for him to do that because the girl is based in Davao and once a month lang nagpupunta sa Manila that’s the time na nagkikita sila. Since it’s the first time na naging unfaithful siya for over9 years in our relationship and he promised that he will not do it again thou super painful ng ginawa niya I gave him a chance but Christmas eve of 2009 when I found out that they still have communication kahit na nagchange na si hubby ng cp# that made me angry and I felt betrayed again for where is his honesty since I accepted him. I asked him to leave the house we were separated for a month then last week of Jan 2010 I again accepted him because I don’t want my kids to grow up w/o their father and he promised to changed for the 2nd time. March 2010 when I found out again his unending na kasinungalingan I saw a small note in his wallet the message is from the girl that made me think that they still has relationship and the girl is just around us hindi talaga taga-Davao based on his kwento we had a big fight when I found out the note he admitted that they still have an affair that made me so disappointed and I felt so much pain for his un-ending betrayals. Pinalayas ko siya then I started to investigate I found out that his mistress is just a co-worker maybe that’s why he wasn’t able to cut their relationship. I was able to confirmed to him he’s mistress, the bitch is 9 years younger than us were 30. I confronted the girl thru telephone as usual the bitch is medyo mayabang pa I reported to their agency ka-imoralan ng employee nila sad to say they didn’t do anything. My husband for the nth time again ask for another chance he resigned, for them not to see each other again and he’s willing to join a marriage counseling for our healing. Fool as I am for still believing in him I accepted him maybe bcoz im still hoping that he will change for me and my kids. We attended marriage counseling for 2 months I can say that he has change unlike before but the story of his betrayals did not end. Nov. 2010 when I found out that from a concern friend that they still have communication so malamang they still see each other here comes the emotional pain again. I waited his cp bill to confirmed the cp# of the girl and bingo may contact pa din sila in-short un-ending na talaga panloloko sa aken ng asawa ko. He again admitted that saying wala lang yun tawag na yun. I’ve had enough of his paglalaro to our family now im planning to file a case of psychological violence under RA9262. I have here email communications with my husband related to his affair and the cp bill indicating the cp# of the girl I also have their changed of notes in a scratch, enough na po bang evidence yun and paano po ba proseso ng magiging case ko vs my husband. Ano po ba puede ko i-file na case against sa mistress nia? Really need your advise po. Thanks in advance.

if you are a recipient of the emails, then you can present them as evidence. if not you will need authorization from the parties because it will be a violation of the right to privacy in communication. what you can show is that there is constant communication between the other girl and your husband.

the term used in RA 9262 is 'repeated marital infidelity'. i am not sure if your evidence is enough, but if there is no other way, then by mere filing of the case, perhaps he will at least stop what he is doing.

Hi Atty,

Thanks po for the reply, ask ko lang po if ano puede ko ifile na case against sa mistress nia since mahirap po i-patunayan sa court ang concubinage may civil or family code po ba na puede ko ikaso sa kanya. Thanks in advance.

moderator
rather than actually file a case against the mistress, what i have done for another client is to send a letter to her directing her to stop else I will initiate a case against her. it's a bit of a bluff, but sometimes a threat is better than an actual thing, and can bring about the same effect.
