Hi Lawyers:

Magandang araw po.

Scenario:
Magre-relocate ang company from Cavite to Batangas. Mag-e-end na ang contract sa building at lupa dito sa Cavite kaya iko-compress na ng company ang production ng Laguna at Cavite plant sa Batangas. Property nila ang building at lupa sa lilipatan (which is in Batangas).

2 options ang offer ng company sa mga employee na mare-relocate;
Option 1 – relocation allowance for two years (pambayad sa bahay na titirhan)
Option 2 – provision of shuttle service for one year.
According sa HR, pwede raw na option 2 muna tapos mag-option 1 pag ayaw na magbyahe (anytime yan pero ibabawas sa two years ng option 1 ang days na nagamit sa option 2. Ex: 3 months na nag-avail ng shuttle, 1 year and 9 months na lang ang ibibigay na relocation allowance). Overall, two years at most ang pinakamatagal na ayuda na ibibigay ng company pag sumama. Beyond that, sagutin na ng empleyado ang gastos. Kung option 1 naman ang pipiliin, hindi pwedeng lumipat ng option 2.

Walang ibinigay na option or treatment sa mga ayaw marelocate.

Reason po ng mga ayaw marelocate is malayo ang lugar, at malalayo sa kani-kanilang pamilya. Issue rin ang health kasi mababawasan na rest time dahil hahaba ang travel time (from Cavite to Batangas vice versa).

Question ko po,
1. any advice ng mga legal options na pedeng i-negotiate sa management kasi ang dating eh RESIGN lang ang option na ipinahihiwatig sa mga hinde willing ma-relocate?
2. Kung sakali, legal po ba na RESIGN lang ang ibigay na option para sa mga regular na empleyado na hinde willing ma-relocate? Meron po bang laban ang empleyado dito?
3. May karapatan po ba ang empleyado na tumangging ma-relocate sa personal na dahilan or sa basis na wla nmng pinirmahan na kontrata ang empleyado anything regarding sa chance na ma-relocate Empleyado o Kumpanya anumang-oras?

2.Yes legal. No walang laban. Karapatan ng kumpanya ang lumagay sa kung saan nila gusto.
3. Pwedeng tumanggi - at magresign.

it is the company's prerogative to change location. consider the shuttle and relocation options also.
