gud eve sir.. ang lupa po na kinatitirikan ng bahay namin ngaun ay pagmamay-ari pala ng banko so we decided na bilihin po ang almost 550 sq. meters na area namin at hinuhulug hulugan ito sa banko since july 2010 kaso hindi namin alam na kasama ng nabili namin ay ang area na binakuran ng army office sa harap ng bahay namin... and we found out after ng survey na pwera sa area na binakuran nila my portion pala ng building ng army na nasakop ang lupa namin, almost 15 sq. meters.. and until now hindi namin mapasok ung area na binakuran nila dahil wala daw abiso mula sa head office nila,so pinuntahan namin ung incharge sa ganitong kaso na head office nila and sinabihan kami na para mapasok namin ang area na binakuran nila kailangan muna namin magpagawa ng deed of donation, saying na idodonate namin sa kanila yong portion na sinakop ng building nila..
wala lang napaka unfair po kac we are paying tax para sa lupa na hindi namin nagagmit at kami pa rin ang gagastos para sa bayad sa pagpapagawa ng deed of donation plus--kung hindi ako nagkakamali kami pa rin ang magbabayad para sa pagpapalit ng area sa title ng lupa namin incase na idonate namin to sa gobyerno..and not mentioned ung price ng almost 15 sq. meters na nasakot ng building nila na 30,000 php.. hindi po kac kami mayaman para mag donate ng ganung kalaking halaga para sa gobyerno.. sana sir mabigyan nyo po kami ng legal advice regarding this matter.. salamt po and more power.. =)

the proper remedy is an accion reivindicatoria to put you back in possession of the property. it is a case filed in court. good luck.
