Question About 30 days Preventive Suspension - Sleeping

My partner is working on a Online Casino as a shuffler and her shift is graveyard.

Gusto ko lang po malaman, na suspend po kasi sya dahil natutulog daw po sya, actually di lang sya marami din sila, pero biglaan ang pag suspend ng walang prior notice kaya gulat na gulat sila meron din po kasi rumor sa kanila na  hindi binibigyan ng 13th month pay ang mga nasuspend. This week lang po pinatawag sya at pinakita sa CCTV mga times na nakapikit nga sya for 10secs, 20sec and ang pinamatagal eh mga 1-2 min mga ganun which I think counted na sleeping talaga pero her employer placed her on a 30 days preventive suspension because of that.

Tanong ko po does it count as a illegal suspension.
Tama po bang 30 days suspension ang sanction even na wala manlang previous warning or memo for sleeping while on duty?

And if ever makukuha nya ba yung salary nya for this cut off. At kung mag reresign po sya? mag kakaroon din po ba sya ng 13th month?

Natanong nya nadin po kasi sa HR nila kung mag reresign sya kailangan nya pa daw mag render after ng suspension and ang option nya lang eh mag pa Early End of Contract.

Medyo kahinahinala lang po yung option nya na mag pa early end of contract. Hindi po ba sya makakakuha ng 13th month kapag ganun?

Preventive suspension is not a sanction. It is a measure to ensure that any investigation done because of the policy violation is not not hindered.

Entitled pa rin ang employee ng pro-rated 13th month pay basta nakapag-trabaho ng at least isang buwan.

i see atty, so ayun po ang alam nya po kasing sanction dun sa violation nya eh deduction sa incentive nya, tama po ba na nasuspend sya kahit po ba hindi sya binigyan ng memo or warning pede po ba sya isuspend agad ng 30 days atty?

how about po dun sa salary nya for this cutoff, may rights po ba ang company na hindi ito ibigay or ihold dahil sa suspension?

sorry atty wala po kasi akong alm sa labor code
