Nag-file po ako ng resignation letter ko last November 23, 2015 but I've just started working on November 7, 2015. I signed a 2-year contract. In the contract, it specifies that I will pay 100% cost of promotion if I will resign without rendering 6months of service. So, at the date of my resignation.. my employer told me that I will pay P2240 composed of cost of promotion for me and the other 2 new employee. So, I agreed and said that by next week I will deposit it.
Next week comes..they texted me if I already deposited it..but i replied if di ba mababawasan kasi di naman nila binigay yung sahod ko sa mga araw na pinasok ko with one week. Then.. hindi po sila nagreply about my question and just said na may obligation ako dahil pirma ko nandun which I totally agreed naman.
Today, tumawag ulit ying company and said P6000 na daw babayaran ko.
These are my questions:
1. Ganun po ba talaga magcompute ng fees of resignation? Yung P2240 po..dapat ba talaga bayaran ko din pati yung promotion na ginawa nila for the other 2 employees?
2. Tama po ba talaga na maging P6000 na ang babayaran ko dahil di ko daw agad nadeposit well in fact idedeposit ko naman yun by last week kung nasagot nila yung tanong ko if may bawas. Wala naman po silang nireply about dun at di na nagtxt pa kaya I assume na nagoffset na lang yung sahod ko sa babayaran ko pang resignation fee.
3. May probability po ba na magfile sila sa akin ng breach of contract kung di ko na bayaran yun dahil at the first place sila po ang sumira sa contract. (Background for my reason of resignation: Ang pasok po namin is Monday to Saturday 9am-6pm. Pero ang nangyayari po is 1:30am na ako nakakauwe. I am well informed na ganun po ang pinapasok kong trabaho pero yung hindi po bayad yung pagovertime dahil under probitionary pa at training lang daw ang ginagawa.)
This was my first job kaya wala po akong kaalam alam pa sa employee -employer stuffs.
Please I really need help.
