1 demand letter deadline on Tue Dec 29, 2015 2:23 pm

Arresto Menor
Meron po sana akong itatanong tungkol po sa housing.
Nakabayad na po kami ng down payment sa real estate now kailangan pong iloan sa bank.
In the process po, nagbigay po ang real estate ng “letter of demand” hanggang end of december2015
Sabi po nila kung di daw po mababayaran yung apartment mawawala daw po sa amin yung bahay namin.
Still in process pa po yung sa bank loan naming kasi di pa naming nababayaran yung bank charges dahil 35k din poi yon
At medyo Malaki kaya di naming agad mabayaran. Ayaw naman po naming mawala sa amin ang pinaghirapan namin.
Tama po ba iyon?  na mawawala sa amin ang hinulugan naming condo apartment?
Ano pong laban naming sa rel estate kung di namin nabayaran yung total amount sa end ng December?
Sana po masagot ninyo yung tanong ko. hindi ko po kasi alam kung anong gagwin sa sitwasyon.

Naka settle na kami ng bank charges, today lang, pero yung processing ng loan name will take 2 weeks,
Pero yung demand letter na ibinigay sa amin ng real estate’s deadline is hanggang katapusan this month.
Ano ang dapat kong gawin? Para hindi sa amin mawala ang unit namin?
I hope matulungan nyo ako sa problema ko.

Perhaps they are at vacation Smile

I don't know much about this, but:

I suppouse you signed a contract saying when the deadline is.
I BELIEVE that give them legal right to take your deposit if you don't fullfil the demands.
BUT if they are decent they will wait a bit. I would go to the bank and try to get a LETTER telling the money us coming soon. Then show that letter to them who demand the money. If you don't get any letter, then TELL now BEFORE deadline the money is DELAYED a bit because of the holidays. (Asuming that's true.)

My Tagalog is bad, so I don't understand what you ask.

Normaly deposits are LOST if next steps aren't paid/signed in time in the beginning. BUT I know in some other types of property cases it's enough to show a LETTER in time from the bank saying they will give loan soon.

we have paid already paid the Full Down Payment. syempre pinaghirapan din naming ang pera pambayad dun sa unit, ayaw naman naming mawala sa amin yung unit.
ano po bang maganda naming gawing hakbang para hindi mawala ang unit na nabayaran na namin?
kung pwede nga lang sana irefund na lang lahat yung naibayad namin yun na lang ang gagawin namin.

Oh down payment, not only a deposit. Can depend of what contract say, but then I suppouse you have some more time, but expect punishment fee for delay.

I don't know if there is any refund chance, but I suppouse still chance to KEEP it.

First, makipag-usap kayo sa developer. Ask for more time.  Hindi po ito guarantee na ma-grant ang inyong request though.

Second,  if the bank has issued a Letter of Guaranty to the developer, you are safe.  If not, you are still at risk of cancellation.

Third, if you decide to back out, you WILL NOT GET A FULL REFUND.  Under the law, the most you will get is 50% - if and only if - you were able to give 24 payments excluding penalties.

If your account is cancelled and all payments forfeited, compile all letters sent and received and go to HLURB to ask for help ASAP.  There is no harm in trying.
