we have an employee under preventive suspension on the day we serve the notice she filed a resignation which we did not accept. We send a notice that we did not receive her explanation and a reminder of the schedule hearing but as expected she did not show up. what will be our next step? what type of notice do we need to send? can we go ahead and send her notice for termination? Thanks

Yes. Since she failed to answer the Notice to Explain, you could then issue the Notice of Termination. Just make sure to indicate therein the findings of the company.

Not yet. Send again another Notice of Admin Hearing indicating therein that 'the resignation letter submitted was not accepted due to the on-going investigation of the case against' the employee. The employee may see your receipt (NOT approval) of his/her resignation letter as an approval. Hence, another notice is warranted.

Set another Hearing and when concluded or when the employee fail to attend the same, a decision of Termination will now be appropriate.
